HomeMy WebLinkAbout2004-03ORDINANCE NO. 2004-03 AMENDING AND ADDING PROVISIONS OF CHAPTERS 2-10 AND 2-13 OF THE DANVILLE MUNICIPAL CODE ESTABLISHING THE POSITION OF YOUTH COMMISSIONER ON THE TOWN OF DANVILLE PARK AND LEISURE SERVICES AND ARTS COMMISSIONS The Danville Town Council does ordain as follows: SECTION 1. Section 2-10.1 of the Danville Munic'ipal Code is hereby amended to read as follows: 2-10.1 Creation of Town Park and Leisure Services Commission. A Park and Leisure Services Commission of the Town of Danville is hereby established. The Park and Leisure Services Commission shall consist of eight (8) regular members, one of which shall be a youth commissioner as defined in Section 2-10.2 below, and one (1) alternate member, all of whom shall be appointed by the Town Council. SECTION 2. Section 2-10.3 of the Danville Municipal Code is hereby amended to read as follows: 2-10.3. Term of Office. With the exception of the youth commissioner, the term of office of each member of the Commission shall be four (4) years unless otherwise determined by the Town Council. The term of each youth commissioner shall be two (2) years. Each member shall serve until their successor is appointed and qualified. SECTION 3. Section 2-10.12 is hereby added to the Danville Municipal Code to read as follows: 2-10.12 Qualifications and Role of Youth Commissioner. The Town Council shall appoint a youth commissioner to serve on the Commission to represent the interests of Danville youth. The youth commissioner shall .be a Danville resident of high school age. The youth commissioner shall have the same obligations and authority of all other commissioners. SECTION 4. Section 2-10.14 is hereby added to the Danville Municipal Code to read as follows: 2-10.14 Commission Alternate. The Town Council may, at its discretion, appoint one alternate to the Park and Leisure Services Commission. The alternate member of the Commission shall attend ali meetings of the Commission. If a regular member of the Commission is absent or required to abstain from all or any part of a Commission meeting, the alternate member shall participate in place of the absent member, with all rights and privileges of a regular member, inclUding the authority to vote on matters before the Commission. SECTION 5. Section 2-13.1 of the Danville Municipal Code is hereby amended to read as follows: 2-13.1 Creation of Danville Arts Commission. An Arts Commission of the Town of Danville is hereby established. The Arts Commission shall consist of eight (8) members, one of which shall be a youth commissioner as defined in Section 2-13.14 below. All members shall be appointed by the Town Council. SECTION 6. Section 2-13.4 of the Danville Municipal Code is hereby amended to read as follows: 2-13.4 Term of Office. With the exception of the youth commissioner, the term of office of each member of the Commission shall be four (4) years unless otherwise determined by the Town Council. The .term of each youth commissioner shall be two (2) years. Each member shall serve until their successor is appointed and qualified. SECTION 7. Section 2-13.13 of the Danville Municipal Code is hereby amended to read as follows: 2-13.13 Residency Requirement. All members of the Commission shall be residents of the Town of Danville. SECTION 8. Section 2-13.14 is hereby added to the Danville Municipal Code to read as follows: 2-13.14 Qualifications and Role of Youth Commissioner. The Town Council shall appoint a youth commissioner to serve on the Commission to represent the interests of Danville youth. The youth commissioner shall be a Danville resident of high school age. The youth commissioner shall have the same obligations and authority of all other commissioners. SECTION 9. CODIFICATION. Sections 1 through 8 of this ordina, nce shall be codified in the Danville Municipal Code. SECTION 10. PUBLICATION AND EFFECTIVE DATE. The City Clerk shall have a s~immary of this ordinance published twice in a newspaper of general circulation, once within five (5) days before its adoption and once within 15 (fifteen) days after adoption. This ordinance shall become effective 30 days after adoption.
