AMENDING CHAPTER 32, SECTION 32-83.11(b), SECTION 32.83.12(c), AND
SECTION 32.83.12(e) OF THE DANVILLE MUNICIPAL
CODE REGARDING PARK LAND DEDICATION FEES
THE TOWN COUNCIL OF THE TOWN OF DANVILLE DOES ORDAIN AS FOLOWS:
SECTION 1. Amending Section 32.83.11(b) of Chapter 32 of the Danville Municipal
Code to read as follows:

SECTION 2. Amending Section 32.83.12(c) of Chapter 32 of the Danville Municipal Code
to read as follows:
Determination of Fair Market Value. The predominant zoning of the Town of Danville is
single family, low density and single family, medium density. Fair market value of a
buildable acre for purposes of fee assessment is based upon the value of single family Iow
density and single family medium density zoned acreage. The Town shall review and
adjust these values as deemed appropriate based on recent sales within and around the

Town and on other reliable sources the Town may choose. The Town may consider the
results of an appraisal report on the value of vacant property or of the County Assessor's
report of changes in assessed value within the Town.
In this section, a buildable acre means a typical acre of the land located in other than an
area on which building is excluded because of flooding, topography, easements, or other
restrictions, and would otherwise be suitable for active park development.
The following fair market values are established as a guide for assessing an in-lieu park
dedication fee:

SECTION 3. Amending Section 32.83.12(e) of Chapter 32 of the Danville Municipal Code
to read as follows:
Establishment of Fees. The amount of the in-lieu fee for various housing types shall be
determined by multiplying the acreage required for dedication from subsection 32-83.11 by
the fair market value in paragraph c. above.

SECTION 4. Amending Section 32.83.12(f) of Chapter 32 of the Danville Municipal Code
to read as follows:
For purposes of this subsection, "Single Family, Detached" shall mean an unattached
residential dwelling unit constructed on a single parcel. "Single Family, Attached" shall
mean attached residential dwelling units constructed on separate parcels. "Duplex" shall
mean two (2) attached residential dwelling units constructed on a single parcel. "Cluster, 3
or 4" shall mean residential dwelling units attached in groups of three (3) or four (4)
constructed on a single parcel. "Cluster, 5 or More" shall mean residential dwelling units
attached in groups of five (5) or more constructed on a single parcel.

SECTION 5. Publication.
The City Clerk shall either a) have this ordinance published once within 15 days after
publication in a newspaper of general circulation or b) have a summary of this ordinance
published twice in a newspaper of general circulation once five days before its adoption
and again within 15 days after adoption.
SECTION 6.
Effective Date.
This ordinance becomes effective 60 days after its adoption.
The foregoing ordinance was first read and introduced on September 16, 2003 and
approved and adopted by the Danville Town Council at a regular meeting on October 8,
2003, by the following vote:
