HomeMy WebLinkAbout043-03RESOLUTION NO. 43-2003 DESIGNATING FIELD EMPLOYEES OF THE CONTRA COSTA MOSQUITO AND VECTOR CONTROL DISTRICT AS HAVING AUTHORITY TO ISSUE ADMINSTRATIVE CITATIONS AND ABATE NUISANCES RELATED TO PUBLIC NUISANCES INVOLVING MOSQUITOES AND VECTORS WHEREAS, the Town of Danville recognizes the potential emergence of the West Nile virus, as well as the continuing presence of vectors such as rodents and skunks, in Contra Costa County and the Town of Danville are matters of increasing public health concern; and WHEREAS, the Town is advised that mosquitoes have the ability to transmit the West Nile virus to humans and other species; and WHEREAS, the Town is advised that rodents, skunks and other vectors have the ability to transmit various diseases to humans and other species; and WHEREAS, the Town has provided that it is a violation of Municipal Code Section 1- 5.4 for anyone to cause or permit to exist a public nuisance; and WHEREAS, the field employees of the Contra Costa Mosquito and Vector Control District (the "District") have training and experience in identifying those public nuisances supporting the development, attraction or harborage of mosquitoes and other vectors, and in abating such nuisances; and WHEREAS, Section 1-5.5 of the Danville Municipal Code provides for the issuance of administrative citations on behalf of the Town to anyone who causes or permits to exist a public nuisance, while Section 1-6.8 of the Municipal Code provides for the summary abatement of public nuisances presenting an immediate threat to the public's health or safety; and WHEREAS, it would benefit the public health and safety of the Town's residents if District field employees were authorized to issue administrative citations on behalf of the Town to anyone causing or permitting to exist a public nuisance involving mosquitoes or other vectors; and WHEREAS, it would further benefit the public health and safety of the Town's residents if District field employees were authorized to abate nuisances supporting the development, attraction or harborage of mosquitoes or other vectors in circumstances constituting an immediate threat to the public's health or safety; now, therefore, be it RESOLVED, that the Danville Town Council authorizes field employees of the Contra Costa Mosquito and Vector Control District to issue administrative citations on behalf of the Town of Danville to address violations related to causing or permitting the existence of a public nuisance involving mosquitoes or other vectors; and be it further RESOLVED, that upon the specific, prior request of the Town in a circumstance constituting an immediate threat to public health or safety, field employees of the District are hereby authorized to abate public nuisances supporting the development, attraction or harborage of mosquitoes or other vectors; and be it further RESOLVED, that to the extent the Town is able to recover the expense of a nuisance abatement carried out by field employees of the District at the request of the Town, the Town shall reimburse the District a portion or all of the District's abatement costs.
