APPROVING HERITAGE RESOURCE DESIGNATION
FOR 404 HARTZ AVENUE
(APN: 208-022-014)
WHEREAS, Eleanor Sherriff is the current owner, and Jeff Mason and Chris Mason are
the applicants in escrow for ownership, of the subject property located at 404 Hartz
Avenue; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation)
establishes standards for review of heritage resources; and
WHEREAS, the histOry of the building is as follows:
The structure is currently located on Lot 8 of Block 2 in the first subdivision plat
Map of Danville recorded by John Hartz in 1891.
2. The historic name for the existing structure on the site is "Foster House."
Research indicates that the existing structure is the second strucVare to be built
on the site in 1926 due to a fire ' ~=
n-, ....that destroyed the original Foster home.
To date, the one-story structure has been utilized as a retail space with no
alterations from its original condition.
The existing structure on the site was built by Joe Foster in a craftsman style of
architecture that was characteristic of the time period in which it was built; and
WHEREAS, Eleanor Sherriff, as property owner, and Jeff Mason and Chris Mason, as
applicants, support the heritage resource designation; and
WHEREAS, the project has been found to be Categorically Exempt from the
requirements of the California Environmental Quality Act (CEQA), Sections 15331,
Class 31; and
WHEREAS, the Danville Heritage Resource Commission adopted Resolution 2003-01
on April 7, 2003, recommending the Town Council approve the Heritage Resource
designation for 404 Hartz Avenue; and
WHEREAS, the public notice of this action was given in all respects as required by law;
and
WHEREAS, a staff report was submitted recommending that the Town Council
approve the request; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony in writing and presented at the hearing; now, therefore, be it
RESOLVED the Danville Town Council approves Heritage Resource Designation for
404 Hartz Avenue based on the following findings and Historic Preservation Ordinance
criteria:
The existing structure on the site is over 50 years old and was built in 1926
(approximately 77 years old).
The site is consistent with Section 32-72.4.h. and i. of the Danville Municipal
Code, Historic Preservation Ordinance, being built on Lot 8, Block 2 of the
Plat Map of Danville which was recorded by John Hartz in 1891, and was
Danville's first subdivision that has evolved over time to become the Town's
downtown core.
The site is consistent with Section 32-72.4.g. of the Danville Municipal Code,
Historic Preservation Ordinance, since the structure has been well maintained
and retained its original historic detailing and materials integrity that have
not been substantially modified over time.
The architecture of the existing building on the site is consistent with Section
32-72.4.a. and g. of the Danville Municipal Code, Historic Preservation
Ordinance, and is representative of a craftsman building that reflects the time
period in which the structure was built in Danville.
APPROVED by the Danville Town Council at a regular meeting on April 15, 2003, by
the following vote:
