DESIGNATING THE DISTRICT ENGINEER, DIRECTING PREPARATION OF
THE ANNUAL REPORT FOR THE DANVILLE STREET LIGHTING AND
LANDSCAPE ASSESSMENT DISTRICT 1983-1 AND APPROVING A CONTRACT
WITH THE DISTRICT ENGINEER
WHEREAS, by its Resolution No. 72-83, the Danville Town Council ordered the
formation of, and levied the first assessment within the Danville Street Lighting and
Landscape Assessment District 1983-1 (the "District") pursuant to the provisions of the
Landscaping and Lighting Act of 1972 (commencing at Section 22500 of the California
Streets and Highways Code), hereafter referred to as the "Act;" and
WHEREAS, pursuant to Section 22622 of the Act, the Town Council must adopt a
resolution generally describing any substantial changes in the District and ordering the
District Engineer to prepare the Engineer's Report required by the Act to establish the
assessment rates for fiscal year 2003/2004; and
WHEREAS, although there are no substantial changes in the physical improvements
maintained by the District, the cost of maintaining those improvements has increased
substantially since assessment rates were ratified in 1997. The increased costs are
attributable to increased costs of electricity, water and other utilities, increased costs for
contracted services and new and improved amenities; and
WHEREAS, in order to offset these increased costs and allow the District to operate
without a deficit, it is necessary to propose increases in the existing assessment rates
through a mail-out ballot procedure as prescribed under Article XIII, Section 4 of the
California Constitution; and
WHEREAS, the Town has previously contracted with the firm of Francisco &
Associates to serve as the District Engineer and desires to continue using the same
District Engineer; now, therefore, be it
RESOLVED, that the Danville Town Council designates Francisco & Associates as
District Engineer for purposes of preparing and filing with the City Clerk a written
report in accordance with Section 22565 of the Act. The District Engineer is directed to
apportion the District assessments in accordance with the benefits received from
improvements by the parcels of land within the District; and be it further
RESOLVED, that the Danville Town Council authorizes the Town Manager to execute
an agreement with Francisco & Associates for the preparation of the District Engineer's
report for fiscal year 2003/2004 and preparation and tabulation of the mail-out balloting
procedure to be conducted by the District for a proposed change in assessment rates.
