GRANTING BRANAGH DEVELOPMENT'S REQUEST TO WAIVE THE
COMMERCIAL TRANSPORTATION IMPROVEMENT PROGRAM (CTIP) FEE FOR
THE COMMERCIAL PROJECT UNDER CONSTRUCTION AT THE SOUTHEAST
CORNER OF THE INTERSECTION OF SCHOOL STREET AND RAILROAD AVENUE
IN RECOGNITION OF THE PUBLIC IMPROVEMENTS INSTALLED BY THE
DEVELOPER ALONG SCHOOL STREET CONVERTING CURBSIDE PARALLEL
PARKING TO CURBSIDE PERPENDICULAR PARKING (APN 208-026-019)
WHEREAS, the Development Plan request DP 2000-43, providing for the construction
of a 5,183+/- square foot two-story retail/office building at the southeast corner of the
intersection of School Street and Railroad Avenue (Assessor's Parcel Number 208-026-
019) was approved by the Danville Planning Commission on January 9, 2001; and
WHEREAS, at that meeting the Planning Commission recommended that the Town
Council waive a portion, or all, of the project's Commercial Transportation
Improvement Program (CTIP) fee in recognition of on-site and off-site improvements to
be constructed by the developer (Branagh Development) along School Street; and
WHEREAS, the staff report submitted for Town Council consideration recommended
that the Council approve the request to waive the CTIP fee (in the form of
reimbursement of the $21,906.00 CTIP fee paid by Branagh Development at the time of
issuance of the building permit for the subject commercial project); now, therefore, be it
RESOLVED, that the Danville Town Council approves Branagh Development's request
to waive the CTIP fee for the project.
APPROVED by the Danville Town Council at a regular meeting on March 4, 2003 by
the following vote:
