RESOLUTION NO. 96-2002
ACCEPTING PUBLIC IMPROVEMENTS AND DEDICATIONS AND
ESTABLISHING THE SATISFACTORY COMPLETION OF IMPROVEMENTS FOR
AUTUMN CREEK WEST, SD 8283, LOCATED AT
THE TERMINUS OF MESSIAN PLACE
WHEREAS, Lenox Homes, LLC, is the subdivider of said subdivision; and
WHEREAS, the subdivider has requested the Town of Danville accept said subdivision
improvements as complete and accept the dedications offered to the Town of Danville on the
recorded subdivision map of Autunm Creek West ~ Instrument No. 2000-276532); and
WHEREAS, the City Engineer has advised that the improvements required as a condition of
that subdivision agreement between the Town of Danville and said subdivider have been
satisfactorily completed; and
WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and
WHEREAS, it is now in the interest of the Town of Danville to:
1. accept those dedications of public streets and other easements on said subdivision
map for the benefit and use of the general public; and
2. accept those public improvements installed as public facilities for the benefit and
use of the general public; and
3. establish those private improvements as complete within said subdivision; and
WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision
improvements and dedications to be accepted; now, therefore, be it
RESOLVED, that the Danville Town Council accepts the following dedications offered for
the public benefit within this subdivision:
1. Messian Place are offered as public street easements

Public Utility Easement(s) (P.U.E.) abutting the public streets are offered
Storm Drain Easement(s) (S.D.E.) on Lot 6 are offered
Landscape Easement(s) abutting Camino Tassajara are offered
Scenic Easement(s) located over a portion of Parcel A are offered
Trail Easement(s) located over a portion of Parcel A are offered
Overland Drainage Release Easement(s) located over a portion of Parcel A are
offered
RESOLVED, that the Town of Danville hereby accepts those public improvements installed
as a condition of this subdivision agreement; and be it further
RESOLVED, that the Town of Danville hereby establishes those private improvements as
complete within this subdivision; and be it further
RESOLVED, that Town staff is authorized and directed to release those securities required
as a condition of this subdivision in accordance with the Danville Municipal Code.

This is to certify that the interests in real property conveyed by the attached instrument
to the Town of Danville in the County of Contra Costa, State of California, are hereby
accepted by the undersigned officer on behalf of the Town of Danville, and the grantee
consents to recordation thereof by its duly authorized officer.
