APPROVING THE TOWN OF DANVILLE 2002/03 to 2006/07
CAPITAL IMPROVEMENT PROGRAM AND APPROPRIATING FUNDS FOR
2002/03 CAPITAL PROJECTS
WHEREAS, Government Code Section 65401 requires the Town of Danville to make a
determination that the 2002/03 to 2006/07 Capital Improvement Program is in conformance with
the Town of Danville General Plan; and
WHEREAS, Government Code Sections 65302 et seq. requires that the Town of Danville must
take into consideration future capital facilities when planning for the development of the
community; and
WHEREAS, the Contra Costa Transportation Authority Growth Management Program requires
that the Town develop a five-year capital improvement program; and
WHEREAS, the Town of Danville staff has prepared the 2002/03 to 2006/07 Capital
Improvement Program; and
WHEREAS, the Planning Commission has reviewed and made a determination that the 2002/03
to 2006/07 Capital Improvement Program is in conformance with the Town of Danville General
Plan; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, the Town Council did hear and consider all reports, recommendations and
testimony submitted and presented at the Capital Improvement Program hearing; and
WHEREAS, the Town Council has determined that the additional funding requested is available
from funding sources as shown within the 2002/03 to 2006/07 Capital Improvement Program;
and
WHEREAS, the Town is scheduled to receive monies from Proposition 12, the Safe
Neighborhood Parks Bond Act of 2000, to develop and renovate parks and recreation-related
facilities; and
WHEREAS, pursuant to California Health and Safety Code Section 33445, the Community
Development Agency of the Town of Danville (the "Agency") is authorized, with the consent of
the Town, to pay part or all of the value of land and cost of construction of buildings and facilities
which are publicly owned and are of benefit to the Project Area; and
WHEREAS, the Town and the Agency entered into a Cooperative Agreement dated December
7, 1987, and an Amended and Restated Cooperative Agreement (the "Cooperative Agreement")
on November 18, 1997 The Cooperative Agreement provides, in part, that the Town may
advance the costs of and construct public improvements in furtherance of the goals of the Plan,
and the Agency may reimburse the Town for such expenditures; and
WHEREAS, the Town and the Agency wish to add the following projects to the list of
Redevelopment Public Improvements subject to reimbursement by the Agency: CIP Project
Numbers A-392, A-411, A-413, A-423, and B-414
WHEREAS, the Town is prepared to advance the costs for construction of the Redevelopment
Public Improvements subject to reimbursement by the Agency from future tax increment revenues
received by the Agency as provided for in the Cooperative Agreement; now, therefore, be it
RESOLVED~ that based upon the findings of fact and law contained in Community
Development Agency Resolution No. 3-2002, adopted July 2, 2002, the Town Council hereby
consents to the future reimbursement by the Agency to the Town for the costs of acquisition and
construction of CIP Project Numbers A-392, A-411, A-413, A-423, and B-414; and, be it further
RESOLVED, that the Town Council of the Town of Danville has determined and orders as
follows: The 2002/03 to 2006/07 Capitallmprovement Program is adopted as recommended by
staff:
Funds shall be appropriated for 2002/03 capital improvement projects as shown on
Attachment C;
Town staff is directed to publish the 2002/03 to 2006/07 Capitallmprovement Program;
The Town Manager is ordered to annually review the Capital Improvement Program and
recommend revisions to the Town Council; and
The Town Manager is hereby instructed to implement the 2002/03 to 2006/07 Capital
Improvement Program.
