APPROVING THE PRELIMINARY ENGINEER'S REPORT, DECLARING
INTENT TO LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2002-03
AND SETTING JUNE 4, 2002 AS THE DATE FOR PUBLIC HEARING
FOR DANVILLE STREET LIGHTING AND LANDSCAPE
ASSESSMENT DISTRICT NO. 1983-1
WHEREAS, on March 6, 2002, the Town Council adopted Resolution No. 25-2002 directing
the preparation of the annual report for Danville Street Lighting and Landscape Assessment
Lighting and Landscape Assessment District No. 1983-1 (the "District"); and
WHEREAS, pursuant to Resolution No. 25-2002, a Preliminary Engineer's Report has been
prepared in accordance with Article 4 (beginning with Section 22565 of the California Streets
and Highways Code) of Chapter 1 of the Landscaping and Lighting Act of 1972, filed with the
City Clerk, and duly considered by this Council; and
WHEREAS, it is the intention of the Town Council to levy and collect assessments within the
District for fiscal year 2002-03. Within the District, the existing and proposed improvements
are generally as described on Exhibit 1 attached hereto and hereby made a part thereof; and
WHEREAS, the District includes all parcels .of land within the incorporated limits of the Town
of Danville; and
WHEREAS, reference is hereby made to the aforementioned Engineer's Report, on file with
the City Clerk, for full detailed description of improvements, the boundaries of the proposed
maintenance assessment district and the proposed assessments upon assessable lots and parcels
of land within said district; and
WHEREAS, the current levies for equivalent dwelling units for Benefit Zones A, B, C and D
are $34.53, $169.28, $42.68 and $54.00 respectively; and
WHEREAS, the proposed fiscal year 2002-03 levies for equivalent dwelling units for all benefit
zones will remain unchanged; now, therefore, be it
RESOLVED, by the Danville Town Council that it declares its intent to levy and collect
assessments for Danville Street Lighting and Landscape Assessment District No. 1983-1 for
fiscal year 2002-03; and, be it further
RESOLVED, that on Tuesday, June 4, 2002 at 7:30 p.m., in the regular meeting place of the
Town Council, 201 Front Street, Danville, California, a public hearing by the Town Council will
be held on the question of levy of the proposed assessments; and, be it further
RESOLVED, that the report prepared and filed by the Engineer on April 19, 2002 contains all
the elements required for such reports by the Landscaping and Lighting Act of 1972 and Article
XIIID, Section 4 of the California Constitution, and is hereby deemed sufficient and
preliminarily approved. These elements include: 1) an estimate of the annual cost of
improvements; 2) a diagram of Assessment District; and 3) an assessment of the estimated
annual costs of improvements. The report shall stand as the Engineer's Report for all subsequent
proceedings under and pursuant to the foregoing resolution.
