APPROVING A REQUEST FOR AUTHORIZATION TO INITIATE A GENERAL
PLAN AMENDMENT STUDY FOR MATT FABER/ROBERT ENEA (OWNERS),
INVOLVING A 0.18 +/- ACRE SITE LOCATED AT 70 RAILROAD AVENUE
WHEREAS, Matt Faber/Robert Enea (Owners) have submitted a request for authorization
of a General Plan Amendment Study (GPA Study), involving a 0.18 +/- acre site located on
70 Railroad Avenue; and
WHEREAS, the subject site is identified as 70 Railroad Avenue and is further identified as
Assessor's Parcel Number 199-330-056; and
WHEREAS, the project proponents have requested that the Town of Danville consider a
General Plan Amendment and Zoning District change from Downtown Business District 4 to
a more appropriate district; and
WHEREAS, the Town of Danville requires Town Council authorization prior to preparation
of GPA Studies; and
WHEREAS, the Danville Town Council did consider the project proponents request at a
hearing on March 19, 2002; and
WHEREAS, a staff report was submitted recommending that the Town Council authorize
the General Plan Amendment Study and direct the project proponents to provide all
information deemed necessary to allow the Town to evaluate the following:
Determine and substantiate the appropriate Floor Area Ratio for the project site. This
analysis should be based, at least in part, on the character of the surrounding properties.
Provide an analysis to determine what percentage of the project's parking requirement
should be allowed to be provided off-site. The analysis should provide an estimate of the
cost of acquiring and constructing off-site parking area(s).
3. Determine and substantiate the appropriate building coverage (i.e., building footprint).
Determine and substantiate the appropriate height and setback standards for the project
site.
Determine the appropriate location of the building on the lot, providing for the possible
future modification of Railroad Avenue to provide for on-street angled parking.
Determine whether possible angled on-street parking improvements can/should be
constructed as part of this project.
Determine the appropriate location of the building on the site, planning for possible
shared access between Railroad Avenue and Hartz Avenue and possible shared parking in
the alleyway behind the building.
Determine whether the access easement to the Chevron site is appropriate or should be
eliminated.
WItEREAS, the Danville Town Council did hear and consider all reports,
recommendations, and testimony submitted in writing and presented at the hearing; now,
therefore, be it
RESOLVED, that the Danville Town Council authorizes the preparation of a GPA Study;
and be it further
RESOLVED, that in authorizing the above-mentioned GPA Study, the Town Council is not
indicating any predisposition to approve the requested General Plan Amendment.
APPROVED by the Danville Town Council at a regular meeting on March 19, 2002 by the
following vote:
