HomeMy WebLinkAbout025-02RESOLUTION NO. 25-2002 DESIGNATING THE DISTRICT ENGINEER, AND DIRECTING THE PREPARATION OF THE ANNUAL REPORT FOR THE DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 AND APPROVING A CONTRACT WITH FRANCISCO AND ASSOCIATES FOR THE DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 AND DANVILLE COMMUNITY FACILITIES DISTRICT 97-1 SERVICES WHEREAS, by its Resolution No. 72-83, the Town Council ordered the formation of, and levied the first assessment within the Danville Street Lighting and Landscape Assessment District 1983-1 (the "District"), pursuant to the provisions of the Landscaping and' Lighting Act of 1972 (commencing at Section 22500 of the California Streets and Highways Code-the "1972 Act"); and WHEREAS, the assessments levied by the District were ratified by the property owners of the District in 1997 as required by the provisions of Proposition 218; and WHEREAS, the District must begin preparing the District Engineer's report and establishing the assessment rates for fiscal year 2002/03, as required by the 1972 Act; and WHEREAS, by its Resolution No. 33-98, the Town Council established the Danville Community Facilities District No. 97-1 for the purpose of extending police services to newly annexed areas of the Town; and WHEREAS, Francisco and Associates are qualified to provide administrative services to the District including preparation of a database and coordination with the County Assessor; now, therefore, be it RESOLVED, that the Danville Town Council does hereby designate Francisco and Associates as District Engineer and directs Francisco and Associates to prepare and file with the City Clerk a written report in accordance with Section 22565 et seq. of the 1972 Act. The District Engineer is further directed to apportion the District assessments in accordance with the special benefits received by the parcels of land within the District; and be it further RESOLVED, that the Danville Town Council approves a professional services agreement between the Town and Francisco and Associates for the preparation of the District Engineer's Report and other duties as District Engineer for fiscal year 2002/03 as well as duties related to Danville Community Facilities District No 97-1.
