HomeMy WebLinkAbout023-02RESOLUTION NO. 23-2002 APPROVING A HERITAGE RESOURCE INCENTIVE PACKAGE FOR THE HISTORIC VECKI HOUSE LOCATED AT 169 FRONT STREET (APN: 208-022-023) WHEREAS, Pearson and Williams, I, LLC are the owners of the subject property located at 169 Front Street; and WHEREAS, on March 20, 2001, the Danville Town Council designated 169 Front Street as a Heritage Resource; and WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires the Heritage Resource Commission to review and recommend Heritage Resource Incentive Packages for Town Council approval; and WHEREAS, on March 27, 2001, Pearson and Williams, I, LLC, as property owners, received Development Plan approval for Phase One of the 169 Front Street project (under Development Plan request DP 2001-05) which, in part, authorized the moving of the historic structure forward on the site and authorized the restoration of the Heritage Resource; and WHEREAS; on October 23, 2001, the Planning Commission conditionally recommended that the Heritage Resource Commission approve Phase Two of the 169 Front Street project (under Development Plan DP 2001-24) and authorized the construction of a new 5000 +/- square foot two-story office building located to the rear of the lot behind the designated Heritage Resource structure with the provision that four parking spaces not be installed along the north property line; and WHEREAS; on October 23, 2001, the Heritage Resource Commission conditionally approved Phase Two of the 169 Front Street project (under Development Plan DP 2001-24) and authorized the construction of a new 5,000 +/- square foot two-story office building located to the rear of the lot behind the designated Heritage Resource structure without four parking spaces along the north property line, but required the applicant to pay in-lieu parking fees for the four spaces; and WHEREAS, on October 23, 2001, the Heritage Resource Commission also reviewed and recommended Town Council approval of a Heritage Resource Incentive Package for 169 Front Street based on their approvals of DP 2001-05 and DP 2001-24; and WHEREAS, Pearson and Williams, I, LLC, as property owners, are applying for Town Council approval of a Heritage Resource Incentive Package that is consistent with the Heritage Resource Commission's approval of the development proposals for 169 Front Street without four parking stalls located along the north property line; and WHEREAS, the Town Council recognizes the value and the unique nature of this historic site which is the oldest remaining building in downtown Danville and wishes to provide a unique incentive package for the project; now, therefore, be it RESOLVED, that the Danville Town Council approves a Heritage Resource Incentive Package for 169 Front Street that includes the following: Allows an 80% Floor Area Ratio (FAR) which is in excess of the maximum 65% that is allowed in Area 3 of the Downtown Business District Ordinance. Allows a five foot rear yard setback, whereas a 20 foot minimum is required in Area 3 of the Downtown Business District. Expands the range of allowable uses that may occupy the second floor of the new structure to include residential use. Waives the downtown parking requirement of the Downtown Business District Ordinance that requires that no more than 25% of a project's required parking be located off-site. Waives parking in-lieu fees at the current rate for all required off-site parking spaces associated with office use of all structures on this site, except for four parking spaces, and agrees to implement a Parking Management Plan for the project per the conditions of approval imposed for DP 2001-24. Commits the Town to assist the property owner in any efforts they undertake to obtain Federal and / or State historic preservation grants and aid. Authorizes the Town Manager, on behalf of the Town, to enter into and execute a Mills Act Contract with the property owner, potentially providing for a reduction in property taxes associated with the historic structure. Waives Transportation Improvement Program (TIP) fees ($4.50/sq. ft. on new conditioned space equaling approximately $23,400). Authorizes application of the provisions of the Historic Building Code to the historic structure. PAGE 2 OF RESOLUTION NO. 23-2002 I0. Waives all Planning application fees (approximately $4,700). 11. Waives all Building Inspection (except plan check fees), childcare, stormwater, Engineering and Planning fees associated with the issuance of building permits (approximately totaling $7,300). 12. Provides a Heritage Resource identification plaque for the site. 13. Includes the site in all marketing plans and public information brochures developed to increase the public's awareness of the Town's Historic Preservation Program.
