APPROVING A
HERITAGE RESOURCE INCENTIVE PACKAGE
FOR THE HISTORIC CABRAL HOUSE LOCATED AT
551 HARTZ AVENUE
(APN: 208-025-003)
WHEREAS, Mark and Kimberly Scott and Ray and Karlyn Hunt, are the owners of the
subject property located at 551 Hartz Avenue; and
WHEREAS, on March 20, 2001, the Danville Town Council designated 551 Hartz Avenue
as a Heritage Resource; and
WHEREAS, Chapter 32-72 of the Danville Municipal Code (Historic Preservation) requires
the Heritage Resource Commission to review and recommend a Heritage Resource Incentive
Package for Town Council consideration; and
WHEREAS, on November 27, 2001, the Planning Commission recommended approval of
Mark and Kimberly Scott and Ray and Karlyn Hunt's request for Development Plan (DP
2001-38); and
WHEREAS, on November 27, 2001, the Heritage Resource Commission conditionally
approved Development Plan (DP 2001-38) which authorized the construction of a 2,855 +/-
two story addition to the rear of the existing Heritage Resource on the site; and
WHEREAS, the property owners are also requesting approval of a Heritage Resource
Incentive Package related to the development proposal for 551 Hartz Avenue; now,
therefore, be it
RESOLVED, that the Danville Town Council approves a Heritage Resource Incentive
Package for 551 Hartz Avenue that includes the following:
Expands the range of allowable uses that may occupy the building to include office
use on the first and second floors, and residential use on the second floor.
Waives the parking in-lieu fees associated with 10 parking spaces (approximately
$75,000) for the project provided that the owner agrees to implement a Parking
Management Plan for the site per the Conditions of Approval E. 1 and E.2 imposed for
DP 2001-38.
Commits the Town to assist the property owner in any efforts they undertake to obtain
Federal and / or State historic preservation grants and aid.
Authorizes the Town Manager, on behalf of the Town, to enter into and execute a
Mills Act Contract with the property owner, potentially providing for a reduction in
property taxes associated with the historic structure.
Waives Transportation Improvement Program (TIP) fees (at $4.50/sq. ft. for new
conditioned space equaling approximately $12,848).
Authorizes application of the provisions of the Historic Building Code to the historic
structure.
7. Waives all Planning application fees (equaling approximately $3,500).
Waives all Building Inspection fees (except fees associated with the plan check
process), child care fees, stormwater fees, Engineering and Planning fees associated
with the issuance of building permits (equaling approximately $4,600).
9. Provides a Heritage Resource identification plaque for the site.

Includes the site in all marketing plans and public information brochures developed to
increase the public's awareness of the Town's Historic Preservation Program.
11.
Provides for a standard loading zone to be established along Hartz Avenue within an
appropriate distance of the site when the owners eliminate the existing driveway curb
cut and install new curb, gutter, sidewalk and beautification improvements per Town
standards along that portion of the property's frontage.
