HomeMy WebLinkAbout009-02RESOLUTION NO. 9-2002 ACCEPTING STORM DRAIN EASEMENTS AND IMPROVEMENTS (SUBDIVISIONS 7850 AND 8213) AND AUTHORIZING EXECUTION OF A SETTLEMENT AGREEMENT WHEREAS, Braddock & Logan was the subdivider of Subdivision 7850 and Taylor Woodrow was the subdivider of Subdivision 8213, which subdivisions geographically adjoin one another; and WHEREAS, the West Pintado Redwoods Association is the homeowners association representing property owners in Subdivision 7850 and the Old Town Owners Association is the homeowners association representing property owners in Subdivision 8213; and WHEREAS, the subdividers installed and the homeowners associations maintain a storm drain system, which system was constructed to standards for a public improvement; and WHEREAS, the subdividers, homeowners associations and the Town of Danville have been involved in litigation over cost sharing and future maintenance of the storm drain system; and VOtEREAS, all of the parties desire to settle the litigation and as part of that settlement, the subdividers and homeowners associations have offered for dedication to the Town the existing stoma drain easements and improvements; now, therefore, be it RESOLVED, that the Danville Town Council accepts the offers of dedication of storm drain easements and the storm drain improvements for Subdivisions 7850 and 8213; and, be it further RESOLVED, that the Danville Town Council authorizes the Mayor to execute the settlement agreement in the case of Braddock & Logan, et al. v. Taylor Woodrow, et al., Contra Costa Case No. C01-00757.
