HomeMy WebLinkAbout123-01RESOLUTION NO. 123-2001 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AGREEMENT WITH EAST BAY MUNICIPAL UTILITY DISTRICT (EBMUD) FOR THE COST SHARING OF LANDSCAPING IMPROVEMENTS AT THE CASTENADA PUMPING PLANT ON CAMINO TASSAJARA WHEREAS, the East Bay Municipal Utility District (EBMUD) owns the 2.24 acre Castenada Pumping Plant site on Camino Tassajara in Danville; and WHEREAS, the Town Council has previously adopted Resolution No. 120-2000, approving a revocable license agreement between the Town and EBMUD, and providing for public access to and use of the Castenada site, consistent with the Town's 2010 General Plan and the Townwide Trails master Plan; and WHEREAS, the license agreement between the Town and EBMUD requires the execution of a cost sharing agreement to set forth the costs to be borne in conjunction with improvement of the Castenada site, and how said costs shall be allocated between the Town and EBMUD; and WHEREAS, the Town's funding responsibility pursuant to the cost sharing agreement is consistent with the funding level authorized in capital project B-376, approved as part of the 2001-2002 Danville Capital Improvement Program; now, therefore be it RESOLVED, that the Danville Town Council hereby approves said cost sharing agreement and authorizes the Town Manager to execute such agreement in the form lodged with the City Clerk.
