HomeMy WebLinkAbout102-01RESOLUTION NO. 102-2001 APPROVING A REQUEST FOR AUTHORIZATION TO INITIATE A GENERAL PLAN AMENDMENT STUDY FOR STANDARD PACIFIC (APPLICANTS) AND JOHN WRIGHT (OWNER) INVOLVING A 3.0+/- ACRE PROPERTY IN THE TASSAJARA RANCH AREA (APN 206-010-048) WHEREAS, Standard Pacific (Applicants) has requested authorization to initiate a General Plan Amendment Study to consider the merits of modifying the land use designation for the 3.0+/- acre property in the Tassajara Ranch area identified as Parcel J of SD 7480; and WHEREAS, the subject property is located at western terminus of Center Way, west of Crow Canyon Road and is further identified as Assessor's Parcel 206-010-048; and WHEREAS, the property currently has a Public and Open Space - Public and Semi-public general plan land use designation; and WHEREAS, Standard Pacific will be pursuing a change of the property's general plan land use designation to either a Residential - Single / Multiple Family designation (4 - 7 units per acre) or a Residential - Multiple Family - Low Density designation (7 - 12 units per acre); and WHEREAS, the intended use of the site is a residential development with a single family detached product in the 6 - 9 units per acre density range (i.e., a proposed density range overlaps existing general plan land use designation categories in the Danville 2010 General Plan); and WHEREAS, authorization to initiate a General Plan Amendment Study is required prior to the Town's review of a General Plan Amendment Study request; and WHEREAS, the Town Council did review the request at a noticed public hearing on October 2, 2001; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, staff recommended the Town Council approve the request; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing, now, therefore, be it RESOLVED, the Town Council of the Town of Danville concurs with the recommendation of staff and authorizes the initiation of a General Plan Amendment Study; and be it further RESOLVED, that the applicant is directed to submit altemative site and circulation plans, with at least one altemative site and cimulation plan required to be submitted that details a small childcare use (i.e., a childcare facility with a 90 - 120 child capacity), a noise study (covering the various alternative site and circulation plans) and a traffic study (covering the various altemative site and circulation plans); and be it further RESOLVED, that the submittal materials for the GPA Study shall address potential security, buffering and lighting issues associated with the subject property's development; and be it further RESOLVED, that in authorizing the above-mentioned General Plan Amendment Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment; and be it further RESOLVED, that if pursued, the following application materials should be submitted for the Town's review in conjunction with the General Plan Amendment Study: Submittal of a Preliminary Development Plan - Rezoning application requesting the property be rezoned from P- 1; Planned Unit Development District to a new P- 1; Planned Unit Development District; 2. An application and plans for a Final Development Plan - Major Subdivision.
