HomeMy WebLinkAbout040-01RESOLUTION NO. 40-2001 APPROVING THE PRELIMINARY ENGINEER'S REPORT, DECLARING INTENT TO LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2001-02 AND SETTING JUNE 5, 2001 AS THE DATE FOR PUBLIC HEARING FOR DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1 WHEREAS, on March 6, 2001, the Town Council adopted Resolution No. 16-2001 directing the preparation of the annual report for Danville Street Lighting and Landscape Assessment Lighting and Landscape Assessment District No. 1983-1 (the "District'i); and WHEREAS, pursuant to Resolution No. 16-2001, a Preliminary Engineer's Report has been prepared in accordance with Article 4 (beginning with Section 22565 of the California Streets and Highways Code) of Chapter 1 of the Landscaping and Lighting Act of 1972, filed with the City Clerk, and duly considered by this Council; and WHEREAS, it is the intention of the Town Council to levy and collect assessments within the District for fiscal year 2001-02. Within the District, the existing and proposed improvements are generally as described on Exhibit 1 attached hereto and hereby made a part thereof; and WHEREAS, the District includes all parcels of land within the incorporated limits of the Town of Danville; and WHEREAS, reference is hereby made to the aforementioned Engineer's Report, on file with the City Clerk, for full detailed description of improvements, the boundaries of the proposed maintenance assessment district and the proposed assessments upon assessable lots and parcels of land within said district; and WHEREAS, the current levies for equivalent dwelling units for Benefit Zones A, B, C and D are $34.53, $169.28, $42.68 and $54.00 respectively; and WItEREAS, the proposed fiscal year 2001-02 levies for equivalent dwelling units for all benefit zones will remain unchanged; now, therefore, be it RESOLVED, by the Danville Town Council that it declares its intent to levy and collect assessments for Danville Street Lighting and Landscape Assessment District No. 1983-1 for fiscal year 2001-02; and, be it further RESOLVED, that on Tuesday, June 5, 2001 at 7:30 p.m., in the regular meeting place of the Town Council, 201 Front Street, Danville, California, a public hearing by the Town Council will be held on the question of levy of the proposed assessments; and, be it further RESOLVED, that the report prepared and filed by the Engineer on April 25, 2001 contains all the elements required for such reports by the Landscaping and Lighting Act of 1972 and Article XIIID, Section 4 of the California Constitution, and is hereby deemed sufficient and preliminarily approved. These elements include: 1) an estimate of the annual cost of improvements; 2) a diagram of Assessment District; and 3) an assessment of the estimated annual costs of improvements. The report shall stand as the Engineer's Report for all subsequent proceedings under and pursuant to the foregoing resolution. APPROVED by the Danville Town Council at a regular meeting on May 1, 2001 by the following vote: AYES: Doyle, Waldo, NOES: None ABSTAINED: None ABSENT: None Arnerich, Greenberg, MAYOR Shimansky APPROVED AS TO FORM: CITY ATTORNEY CITY CLERK PAGE 2 OF RESOLUTION NO. 40-2001 DESCRIPTION OF IMPROVEMENTS TOWN OF DANVILLE DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1 The improvements which can be operated, maintained and serviced by the District consist of landscaping, street lighting, public park facilities and appurtenant facilities including, but not limited to personnel, electrical energy, utilities such as water, materials, contractual services, and other items necessary for the facilities described below: (1) Landscaping The landscaping improvements which will be operated, maintained and serviced by the District consist of the following streetscapes and feature areas: Streetscapes Camino Ramon Camino Tassajara Crow Canyon Road Danville Boulevard Diablo Road E1 Capitan Drive E1 Cerro Boulevard Greenbrook Drive Historic Downtown Area Old Orchard Road San Ramon Valley Boulevard Sycamore Valley Road Tassajara Ranch Drive FeatureAreas Creek Edge Treatment Freeway Interchanges Entries Intersections Medians Roadsides All landscape treatment is in conformance with the "Town of Danville Streetscape Beautification Guidelines," dated April 1986. Landscaping improvements include, but are not limited to: landscaping, irrigation, hardscapes, trees, special paving, landscape walls, fumishings such as planters, bollards, tree grates and appurtenant facilities as required to provide aesthetically pleasing environment throughout the District. (2) StreetLighting The street lighting system which will be operated, maintained and serviced by the District consists of the lighted areas located in the former portions of Contra Costa County Service areas L-42, M-6, M-21 and M-22 to the extent Page 1 of Exhibit 1 to Resolution No. 40-2001 (3) they fall within the incorporated limits of the Town of Danville. Recently subdivided lands and other parcels located within the limits of the Town of Danville which have street lighting facilities are also included. Street lights and appurtenant facilities include, but are not limited to, poles, fixtures, bulbs, conduits, equipment including guys, anchors, posts, pedestals, and meeting devices as required to provide safe lighting within the boundaries of the District. Public Park and Recreational Facilities The public park facilities which are located within the incorporated limits of the Town of Danville will be operated, maintained and serviced by the District. Public park and recreational facilities include, but are not limited to: landscaping, irrigation systems, hardscapes, sidewalks, trails, fixtures, and appurtenant facilities including but not limited to lights, playground equipment, play courts, public restrooms, sports fields, parkways, and designated easements within the boundaries of these parks, and buildings or structures used for the support of recreational programs.
