APPROVING HERITAGE RESOURCE DESIGNATION
FOR 551 HARTZ AVENUE
(APN: 208-025-003)
WHEREAS, Mark and Kim Scott and Karlyn and Ray Hunt are the owners of the subject
property located at 551 Hartz Avenue (APN: 208-025-003); and
WHEREAS, Chapter 32-72 of the DanviIle Municipal Code (Historic Preservation) establishes
standards for review and designation of Heritage Resources; and
WHEREAS, the history of the building is as follows:
1. The site is shown as Lot 4, Block 5 in the first subdivision plat map of Danville recorded
by John Hartz in 1891.
2. Research indicates that the lot remained vacant through 1932 and the existing structure
was the first structure to be built on the site, probably in the mid to late 1930s.
3. To date, the structure has been utilized as a residence and has been kept in pristine
condition.
4. The existing structure on the site was built by Joe Foster in a simple depression-style
eclectic bungalow/craftsmen style of architecture that was characteristic of the time period
in which it was built; and
WHEREAS, Mark and Kim Scott and Karlyn and Ray Hunt, as property owners, support the
Heritage Resource designation; and
WHEREAS, Mark and Kim Scott and Karlyn and Ray Hunt, as property owners, have applied
for a Temporary Land Use Permit (LUP 2001-02) to utilize the existing house for office use and
plan to pursue approval of a Final Development Plan that includes construction of a new office
building located to the rear of the lot and an incentive package for the entire site; and
WHEREAS, the project has been found to be Categorically Exempt from the requirements of the
California Environmental Quality Act (CEQA), Sections 15331, Class 31; and
WHEREAS, the Danville Heritage Resource Commission adopted Resolution No. 2001-01 on
February 12, 2001 in support of the Heritage Resource designation for 551 Hartz Avenue; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
request; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED, that the Danville Town Council supports the use of the existing structure as an
office per the conditions of approval for Temporary Land Use Permit LUP 2001-02 and grants
the Heritage Resource designation for 551 Hartz Avenue based on the following findings and
Historic Preservation Ordinance 32-72.4 criteria:
The existing structure on the site is over 50 years old and was built in the mid-to-late
1930s (approximately 68 years old).
Criteria h and i: The existing structure on the site is the first house built on Lot 4,
Block 5 of the Plat Map of Danville which was recorded by John Hartz in 1891, and
was Danville's first subdivision that has evolved over time to become the Town's
downtown core.
Criteria g: The structure has been well maintained and retained its original historic
detailing and materials integrity that have not been substantially modified over time.
Criteria a and g: The architecture of the existing building on the site is representative
of a simple depression-style eclectic Craftsmen Bungalow/Spanish building that
reflects the time period in which the structure was built in Danville.
APPROVED by the Danville Town Council at a regular meeting on March 20, 2001 by the
following vote:
