APPROVING A REQUEST FOR AUTHORIZATION TO INITIATE A GENERAL
PLAN AMENDMENT STUDY TO AMEND THE LAND USE DESIGNATION
FOR TWELVE EXISTING PARCELS LOCATED ON THE EAST SIDE
OF LAWRENCE ROAD SOUTH OF SHELTERWOOD LANE FROM
RESIDENTIAL - COUNTRY ESTATES (1 ACRE LOT MINIMUM)
TO RESIDENTIAL - SINGLE FAMILY - LOW DENSITY
(1-3 UNITS PER ACRE)
WHEREAS, Gary Wincott (Applicant) has requested authorization of a General Plan
Amendment Study request to study the merits of amending the Town's General Plan Land
Use Designation for the site from Residential - Country Estates (1 acre lot minimum) to
Residential - Single Family - Low Density (1-3 units per acre); and
WHEREAS, the subject parcels include 1349, 1329, 1365, 1315, 1357, 1345, 1353, 1327,
1485, 1361, 1333, and 1321 Lawrence Road and are further identified as Assessor's Parcel
Numbers 206-140-006, 011,015, 019, 025, 009, 012, 017, 020, 026, 010, and 018, and are
owned by Wayne & Jacquelyn Lazenby, David & Lisa Beckemeyer, Frederick & Jerris
Braese, David & Linda Butler, Ahmadreza Fattahi, Michael & Kathleen Rogers, Mike &
Allyn Terpstra, Bhushan & Saroj Bansal, Gayle Rivers and Lois Rivers, Nancy & John
Harrison, Charles & Mary Ann Andrews, and Steven & Shannon Nornhold (Owners); and
WHEREAS, authorization to initiate a General Plan Amendment Study is required prior to
the Town's review of a General Plan Amendment request; and
WHEREAS~ the application seeks to amend the General Plan land use designation for the
site, changing the designation from Residential - Country Estates (1 acre lot minimum); and
WHEREAS, the existing land use designation was established by way of adoption of the
Lawrence / Leema Road Specific Plan; and
WHEREAS, the current land use designation for the subject properties was reaffirmed by
the Town Council with their recent action to approve a Town-wide General Plan Update;
WHEREAS, the subject property owners now seek to amend the General Plan land use
designation to Residential - Single Family - Low Density (1-3 units per acre); and
WHEREAS, the Town Council did review the request at a noticed public hearing on March
6, 2001; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, as a response to recent prior, identical General Plan Amendment Study requests
(forwarded by a few of the subject property owners in the context of the recent Town-wide
General Plan Update efforts), the Town Council and the Planning Commission indicated their
support for the existing Lawrence / Leema Road Specific Plan, the goals and policies of the
existing Plan and the land use designations placed on the subject properties by the Plan; and
WHEREAS, circumstances affecting the subject properties have not changed; and
WHEREAS, in response to the current request, staff recommended the Town Council
discourage the request; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; and
WHEREAS, only because the property owners are allowed to pursue General Plan Amendment
Studies for their properties, now, therefore, be it
RESOLVED, that the Danville Town Council approves the request for authorization to
initiate a General Plan Amendment Study; and be it further
RESOLVED, that in authorizing the above-mentioned General Plan Amendment Study, the
Town Council is not indicating any predisposition to approve the requested General Plan
Amendment; and be it further
RESOLVED, that the application filed for the General Plan Amendment Study must be signed
by each of the property owners, or their designated representatives, of the properties involved
with this request; and, be it further
RESOLVED, that if pursued, the following application materials should be submitted for the
Town's review:
An application for a Preliminary Development Plan - Rezoning application to request
to rezone the site from P-l; Planned Unit Development District to a new P-l; Planned
Unit Development District;
An application and plans for a Final Development Plan - Major Subdivision. The
tentative map should depict the proposed layout of development showing how new
development would be coordinated with the existing homes.
