HomeMy WebLinkAbout002-01RESOLUTION NO. 2-2001 AUTHORIZING THE TOWN MANAGER TO EXECUTE A LICENSE AGREEMENT BETWEEN THE TOWN OF DANVILLE AND EAST BAY REGIONAL PARK DISTRICT FORMALIZING THE DISTRICT'S RIGHTS AND RESPONSIBILITIES REGARDING THE MAINTENANCE OF A TOWN-OWNED SECTION OF THE IRON HORSE REGIONAL TRAIL LOCATED NEAR PROSPECT AVENUE WHEREAS, the Town of Danville and East Bay Regional Park District (EBRPD) staff have worked together over the last year with the preparation of a license agreement that will serve to formalize the EBRPD's rights and responsibilities regarding the maintenance of the section of the Iron Horse Regional Trail that runs the length of the Town-owned Railroad Avenue Municipal Parking Lot; and WHEREAS, as owner of the Railroad Avenue Municipal Parking Lot, the Town controls ownership of a 750+/- foot segment of the Iron Horse Regional Trail; and WHEREAS, it is a standard practice of EBRPD to enter into a license agreement with the property owners of the land occupied by the trail to address ongoing maintenance of the regional trail facility; and WHEREAS, the Town Council reviewed the license agreement submitted by EBRPD at their meeting of January 16, 2001; and WHEREAS, a staff report was submitted recommending that the Town Council approve the license agreement; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the license agreement formalizing EBRPD's rights and responsibilities regarding the maintenance of a Town-owned section of the Iron Horse Regional Trail located near Prospect Avenue is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the license agreement with EBRPD in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
