HomeMy WebLinkAbout105-00RESOLUTION NO. 105-2000 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE FOR-SALE MODERATE INCOME UNITS REQUIRED TO BE ESTABLISHED IN PUD 98-09 AND SD 8332 "QUAIL GARDENS" - CASTLE CONSTRUCTION COMPANY (3871 OLD BLACKHAWK ROAD) WHEREAS, on February 1, 2000 the Danville Town Council adopted Resolution No. 6- 2000 approving PUD 98-09 and SD 8332 for a single family residential project in the Old Blackhawk Road Specific Plan Area; and WHEREAS, the action provides for the construction of a 40-unit single family residential project over 5.4+/- acres located 3871 Old Blackhawk Road (in the vicinity of the southeast corner of the intersection of Old Blackhawk Road and Maison Drive and being further identified as APN~t 203-200-063); and WHEREAS, conditions of approval for the project require that Castle Construction Company construct a total of four units which shall have sale prices that do not exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Castle Construction Company is required to execute an Affordable Housing Agreement ("agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Castle Construction Company for the regulation of occupancy, sale and resale of the affordable housing units in the subject development on August 1, 2000; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Castle Construction Company for the affordable housing units; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the four affordable housing units to be developed within PUD 98-09 and SD 8332 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Castle Construction Company in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
