HomeMy WebLinkAbout093-00RESOLUTION NO. 93-2000 SUBMITTING A BALLOT MEASURE TO THE VOTERS ON NOVEMBER 7, 2000, "THE DANVILLE OPEN SPACE PRESERVATION INITIATIVE," SPECIFYING BALLOT WORDING FOR THE MEASURE, PROVIDING FOR THE FILING OF BALLOT ARGUMENTS AND REBUTTALS AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS OF THE MEASURE WHEREAS, in August 1999, the Danville Town Council adopted the Town of Danville 2010 General Plan; and WHEREAS, the Town Council, acting pursuant to the California Environmental Quality Act CCEQA"), considered and adopted a mitigated negative declaration in conjunction with the adoption of the 2010 General Plan; and WHEREAS, the Danville Town Council, acting pursuant to Section 9222 of the Elections Code, wishes to submit a ballot measure, the "Danville Open Space Preservation Initiative," to the voters of the Town of Danville at the municipal election to be held on November 7, 2000, which ballot measure would reaffirm certain land use designations contained in the 2010 General Plan and require voter approval .for future changes in those land use designations; and WHEREAS, since adoption of the 2010 General Plan and the mitigated negative declaration, there have been no new information or change in circumstances regarding the land use designations proposed to be affected by the ballot measure; and WHEREAS, the Town Council has adopted Resolution No. 91-2000 asking the Contra Costs County Elections Department to consolidate the Town's municipal election on November 7, 2000, and conduct the necessary proceedings; and WHEREAS, the Town Council must now take the necessary actions related to submitting the ballot measure to the voters; and WHEREAS, those actions include specifying ballot wording for the measure, authorizing the City Attomey to draft an impartial analysis of the measure, and authorizing the City Clerk to receive ballot arguments and rebuttals to those arguments; now, therefore, be it RESOLVED, by the Danvilte Town Council that a ballot measure, the "Danville Open Space Preservation Initiative," amending the Town of Danville's 2010 General Plan to require voter affirmation for amendments to certain land use designations in the General Plan shall be submitted to the voters on November 7, 2000; and be it further RESOLVED, that the ballot wording to be submitted to the voters on November 7, 2000, shall read as follows: "Shall the people of the Town of Danville enact an amendment to the Town's General Plan, known as the Danville Open Space Preservation Initiative, to preserve Agricultural, General Open Space and Parks and Recreation Land Use Designations and requiring voter approval for future general plan amendments to lands with those designations?" and, be it further RESOLVED, that the proposed ballot measure is exempt from CEQA because it would only result in an organizational and administrative change in the processing of certain general plan amendments not resulting in any direct physical change in the environment or any reasonably foreseeable indirect physical changes in the environment; and, be it further RESOLVED, that the Danville Town Council directs the City Attorney to draft an impartial analysis of the ballot measure; and, be it further RESOLVED, that the City Clerk shall receive ballot arguments for the ballot measure not exceeding 300 words in length by 5:00 p.m. on August 15; and, be it further RESOLVED, that the City Clerk shall receive rebuttal arguments for the ballot measure not exceeding 250 words in length by 5:00 p.m. on August 25.
