HomeMy WebLinkAbout011-00RESOLUTION NO. 11-2000 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE FOR-SALE MODERATE INCOME UNIT REQUIRED TO BE ESTABLISHED IN PUD 98-07 / SD 8213 "OLD TOWN" - TAYLOR WOODROW HOMES, INC. (309 WEST EL PINTADO ROAD) WHEREAS, On October 15, 1999, the Danville Town Council adopted Resolution No. 153- 99 approving PUD 98-07 and SD 8213, authorizing the construction of a 16 unit single family residential project. The approval was granted to Taylor Woodrow Homes, Inc.; and WHEREAS, the action authorizes the construction of a 16-unit single family residential project over 2.2+/- acres located 309 West El Pintado Road, and being further identified as APN# 200-170-006; and WHEREAS, conditions of approval for the project require Taylor Woodrow Homes, Inc. to construct one affordable housing unit in the project which shall have a sales price that does not exceed the maximum price affordable to a four-person household earning 110% of the median income established for ConIra Costa and Alameda Counties; and WHEREAS, Taylor Woodrow Homes, Inc. is required to execute an Affordable Housing Agreement ("agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing unit; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of'Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Taylor Woodrow Homes, Inc. for the regulation of occupancy, sale and resale of the affordable housing unit in the subject development on February 1, 2000; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Taylor Woodrow Homes, Ineo for the affordable housing unit; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the affordable housing unit to be developed by PUD 98-07 and SD 8213 is appropriate; and, be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Taylor Woodrow Homes, Inc. in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
