AWARDING A CONTRACT FOR
SYCAMORE/TASSAJARA/CROW CANYON MEDIANS
CONTRACT NO. B-332
WHEREAS, the Danville Town Council approved the call for bids for the
Sycamore/TassajaraJCrow Canyon Medians project on August 3, 1999; and
WHEREAS, sufficient funds have been appropriated in the Capital Improvement Program,
Project No. B-332 budget to construct this project; and
WHEREAS, the City Clerk of the Town of Danville did, in open session on the 4th day of
November, 1999, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the apparent low bidder, Goodland Landscape Construction Inc., has requested to
retract their bid based upon an error, as defined in Section 5103 of the Public Contract Code; and
WHEREAS, the lowest responsible bidder is Valley Crest Landscape Company of Pleasanton
California, and the City Engineer has recommended awarding a contract for the project to said
firm; now, therefore be it
RESOLVED, that the Danville Town Council hereby authorizes the award of contract for the
construction of Sycamore/Tassajara/Crow Canyon Medians to Valley Crest Landscape Company
of California; and, be it further
RESOLVED, that Goodland Landscape Construction Inc. 's request to retract their bid is granted;
and, be it further
RESOLVED, by the Danville Town Council that the Town Manager be and hereby is authorized
to execute, on behalf of the Town, a written contract with Valley Crest Landscape Company, for
$398,120.50, plus a 20% contingency of $79,624 for a total of $477,744.50 for work in
connection with the Sycamore/Tassajara/Crow Canyon Median project, in the form lodged with
the City Clerk, together with such changes as may hereafter be determined necessary, provided
such changes do not materially increase the obligations to the Town thereunder, and to receive and
approve all bonds in connection therewith, and the City Clerk is hereby directed to attest same
affix thereto the official seal of the Town; and; be it further
RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial Relations,
Division of Apprenticeships Standards. P.O. Box 603, San Francisco, CA 94101. (Note: Should
a finding of any discrepancy regarding this ratio of apprentices to journeymen is made, the Town
shall notify the Division of Apprenticeship Standards of such findings.)
APPROVED by the Danville Town Council at a regular meeting on November 16, 1999 by the
following vote:
