HomeMy WebLinkAbout134-99RESOLUTION NO. 134-99 AWARDING CONTRACT FOR IRON HORSE TRAIL REST AREA AT PROSPECT AND QUINTERRA, PHASE 2, CONTRACT NO. B-322B WHEREAS, the Danville Town Council approved the call for bids for the Iron Horse Trail Rest Area at Prospect and Quinterra, Phase 2; and WHEREAS, sufficient funds have been appropriated to cover the cost of the project; and WHEREAS, the City Clerk of this Town did, in open session on the 261h day of August, 1999, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the low bidder is Cleary Broso of Danville and the City Engineer has recommended awarding a contract for the project to said firm; and WHEREAS, access rights necessary for construction of this project are being acquired from the County and East Bay Regional Park District; now, therefore, be it RESOLVED, by the Danville Town Council that the Town award the contract for the Iron Horse Rest Area at Prospect and Quimerra, Phase 2, to Cleary Bros. of Danville; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Cleary Bros. for $84,716 plus a 10% construction comingency of $8,472 for a total of $93,188 for work in connection with the Iron Horse Trail Rest Area at Prospect and Quinterra, Phase 2, in the form as lodged with the City Clerk, together with such changes as may hereafter be determined necessary, provided such changes do not materially increase the obligations to the Town thereunder, and to receive and approve all bonds in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to joumeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
