HomeMy WebLinkAbout076-99RESOLUTION NO. 76-99 AWARDING CONTRACT AND APPROPRIATING ADDITIONAL PARK FUND MONIES FOR THE OAK HILL PARK PLAY AREA RENOVATION, CONTRACT NO. B-275. WHEREAS, the Danville Town Council has previously approved the call for bids for Oak Hill Park Play Area renovation; and WHEREAS, the City Clerk of the Town of Danville did, in open session on the 1st day of September 1998, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the three bids received exceeded the Engineer's estimate and the City Engineer rejected the bids and called for new bids; WHEREAS, the City Clerk of the Town of Danville did, in open session on the 8th day of April 1999, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, the bids received exceed the project appropriation and the Parks and Leisure Services Commission recommended appropriating additional Park Fund monies; and WHEREAS, the low bidder is Cleary Bros. Landscape Construction of Danville and the City Engineer has recommended awarding a contract for the project to said firm; now, therefore be it RESOLVED, by the Danville Town Council that the Town award the contract for the Oak Hill Park Play Area renovation to Cleary Bros. Landscape Construction of Danville; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is authorized to execute, on behalf of the Town, a written contract with Cleary Bros. Landscape Construction for $283,103.83 plus a 15% construction contingency of $42,466 for a total of $325,570 for work in connection with the Oak Hill Park play area renovation project, in the form lodged with the City Clerk, together with such changes as may hereafter be determined necessary, provided such changes do not materially increase the obligations to the Town thereunder, and to receive and approve all bonds in connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and, be it further RESOLVED, that the City Clerk shall within five (5) days of the adoption of this resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to joumeymen is made, the Town shall notify the Division of Apprenticeship Standards of such findings.)
