HomeMy WebLinkAbout061-99RESOLUTION NO. 61-99 ADOPTING SPECIFICATIONS AND STANDARDS FOR ENCROACHMENT PERMITS ISSUED FOR UTILITY INSTALLATION IN PUBLIC STREETS WHEREAS, the 314 miles of public streets owned and maintained by the Town of Danville represent the Town's largest capital asset; and WHEREAS, the Town annually spends an average of $750,000 to improve and maintain the public street system; and WHEREAS, one of the leading sources of damage to the Town's streets are imprope~y repaired utility trenches cut into the Town's streets; and WHEREAS, improved coordination between utilities and the Town will benefit both the utilities and the Town by minimizing costs and allowing for better maintenance of the Town's public streets; and WHEREAS, Section 12-1.4 of the Danville Municipal Code requires any person or entity placing any pipe, conduit or other fixture in or under the Town's public streets to first obtain an encroachment permit; and WHEREAS, Section 12-4-6 of the Danville Municipal Code requires that upon completion of any work to a public street performed pursuant to an encroachment permit, the permittee shall repair and restore the street as provided for in the Municipal Code and adopted specifications; and WltEREAS, Sections 12-4.8 and 12-4.12 of the Danville Municipal Code provide that the City Engineer and Town Council may adopt specifications for backfilling and compaction of excavations to public streets and for the repair of public streets; and WHEREAS, Section 12-4.10 of the Danville Municipal Code encourages installation of utilities by means other than trenching or cutting the surface of public streets; and WHEREAS, acting pursuant to the authority of Chapter 12 of the Danville Municipal Code, the City Engineer has prepared specifications and standards for the issuance of encroachment permits which address: limiting the use of street cuts; promoting better coordination with utilities serving the Town; proper backfilling and compaction of trenches cut in public streets; and, repair and restoration of trench excavations and pavement of public streets; and WHEREAS, the Danville Town Council wishes to adopt these specifications as provided for in Chapter 12 of the Danville Municipal Code; now, therefore, be it RESOLVED, that the Town of Danville adopts the encroachment permit specifications and standards attached hereto as Exhibit 1. APPROVED by the Danville Town Council at a regular meeting on April 20, 1999, by the following vote: AYES: Arnerich, NOES: None ABSTAINED: None ABSENT: None Greenberg, Doyle, Shimansky, Waldo MAYOR APPROVED AS TO FORM: ATTEST: CITY ATTORNEY CITY CLERK PAGE 2 OF RESOLUTION NO. 61-99 TOWN OF DANVILLE STANDARDS AND SPECIFICATIONS FOR ENCROACHMENT PERMITS-STREET CUTS 1. With the exception of emergency repairs, no person, corporation or entity shall encroach in the public right-of-way without first obtaining an encroachment permit from the City Engineer. 2. It is the policy of the Town that cutting or trenching of public streets shall be used only when necessary. Before authorizing such trenching in public streets, the City Engineer shall review other means of installing the necessary utilities (such as jack and bore) and other locations for installation of the utilities (such as in landscaped areas or sidewalks). The installation of overhead utilities is not to be considered an acceptable alternative. 3. All cuts or trenches in public streets shall comply with Standard Plan 114 (available from the City Engineer) for backfilling, compaction and pavement restoration. Emergency trenches done without encroachment permits shall comply with these standards. 4. The City Engineer shall hold periodic meetings with all utilities providing service within the Town to review proposed capital improvement plans. 5. For street cuts or trenches, the permittee shall be responsible for slurry sealing the width of the travel lane for the length of the trench if the street had been slurry sealed within three years prior to the cut or overlaid within ten years prior to the cut. 6. Consistent with Section 12-3 of the Danville Municipal Code, the City Engineer, prior to issuance of an encroachment permit authorizing cutting or trenching in a public street, shall require a cash deposit and/or a bond in an amount sufficient to ensure restoration of the street to its former condition consistent with the standards contained herein.
