HomeMy WebLinkAbout046-99 RESOLUTION NO. 46-99 AUTHORIZING THE MAYOR TO SIGN CORRESPONDENCE REPRESENTING THE TOWN COUNCIL'S POSITION ON CURRENT LEGISLATION WHEREAS, the State Legislature in recem years has significantly impacted local government revenues; and WHEREAS, the Town has responded to legislation by writing letters from the Mayor as needed; and WHEREAS, prior discussion and establishing a position on state legislative matters by the Town Council would lend greater weight to the Town' s legislative efforts; and WHEREAS, approval of the positions outlined in Exhibit 1 will initiate a response on behalf of the Town Council in support or opposition of specific legislation; now, therefore, be it RESOLVED, that the Town Council authorizes the Mayor to sign correspondence representing the Town Council's position on legislation described in Exhibit 1. APPROVED by the Danville Town Council at a regular meeting on April 6, 1999, by the following vote: AYES: Arnerich, NOES: None ABSTAINED: None ABSENT: None Greenberg, Doyle, Shimansky, Waldo MA OR APPROVED AS TO FORM: CITY ATTORNEY ATTEST: CITY CLERK Current Legislation - 1999 Session BILL # AND AUTHOR AB 304 - Wildman SB 165 - Rainey AB 83 - Cardenas SB 153 - Haynes SB 1200 - Poochigan AB- 1549 - Torlakson SB3 - Rainey DESCRIPTION Reduces diversion into the ERAF augmentation fund over a 10 year period. Reduces diversion into the ERAF augmentation fund over an unspecified period of time. Exempts home based businesses from business license fees. Requires "takings" impact analysis prior to actions with potential to significantly impair use of private property. Prohibits a local agency from disapproving application for drive-thru facility that makes application infeasible. Mandates District elections for Central Contra Costa Sanitary District. Provide funds for Library construction and renovation. RECOMMENDATION Support legislation - position urged by League. Support legislation - position urged by League. Oppose legislation - position urged by League. Oppose legislation - position urged by League. Oppose legislation - position urged by League. Oppose legislation - urged by CCCSD and City of Walnut Creek. Support legislation - urged by Senator Rainey. REASONS Return of local government funds redirected to ERAF. Remm of local government funds redirected to ERAF. Reduction in local revenues. Existing practice - courts decide "takings." Limitation of local land use authority. Past experience with Utility District politics where Town of Danville lost effective representation (EBMUD). Support for Contra Costa Library system which would benefit from additional funding.
