HomeMy WebLinkAbout021-99RESOLUTION NO. 21-99 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE MODERATE INCOME HOUSING UNITS TO BE ESTABLISHED IN SD 8014 - GREENTREE MANOR APARTMENTS - CASTLE CONSTRUCTION COMPANY, INC. (SAN RAMON VALLEY BOULEVARD AND PODVA ROAD) WHEREAS, at meetings on August 5, 1997 and October 7, 1997, the Danville Town Council adopted Ordinance No. 97-04 and Resolution No. 77A-97 approving Preliminary and Final Development Plan-Rezoning request PUD 96-04 and Final Development - Major Subdivision request SD 8014; and WHEREAS, the approvals provide the applicants (Castle Construction Company, Inc.) authorization for a 38-unit apartment/condominium development on a 2.33+/- acre site located at the northwest corner of the intersection of San Ramon Valley Boulevard and Podva Road; and WHEREAS, conditions of approval for the project linked the approval to the provision of either for-rent or for-sale affordable housing units earning a maximum of 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Castle Construction Company, Inc. is required to execute an affordable housing agreement with the Town of Danville regulating the occupancy, rent, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Castle Construction Company, Inc. for the regulation of occupancy, rent, sale and resale of the affordable housing units in the subject development on March 2, 1999; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Castle Construction Company, Inc. for the affordable housing units; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the affordable housing unit to be developed within PUD 96-04 / SD 8014 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the affordable housing agreement with Castle Construction Company, Inc. in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
