AUTHORIZING THE TOWN MANAGER TO
EXECUTE AN AFFORDABLE HOUSING AGREEMENT
FOR THE MODERATE INCOME HOUSING UNITS TO BE ESTABLISHED IN
PUD 98-05 / SD 8204 RYLAND COTTAGES - RYLAND HOMES NORTHERN
CALIFORNIA DIVISION (LA GONDA WAY)
WHEREAS, at meetings on November 17, 1998 and December 15, 1998, the Danville Town
Council adopted Ordinance No. 98-13 and Resolution No. 174-98, approving Preliminary and
Final Development Plan-Rezoning request PUD 98-05 and Final Development - Major
Subdivision request SD 8204; and
WHEREAS, the approvals provide the applicants (Ryland Homes - Northem California
Division) authorization for a 39-lot residential development on a 3.31 +/- acre site located at 452,
456, 464 and 472 La Gonda Way; and
WHEREAS, conditions of approval for the project linked the approva~ to the provision of eight
for-sale residential units at a sale price affordable to a four-person household earning a maximum
of 110% of the median income established for Contra Costa and Alameda Counties; and
WHEREAS, Ryland Homes is required to execute an affordable housing agreement with the
Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and
WHEREAS, promoting the development of affordable housing within the Town of Danville is
a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and
WHEREAS, the Town Council reviewed the agreement submitted by Ryland Homes for the
regulation of occupancy, sale and resale of the affordable housing units in the subject
development on March 2, 1999; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
agreement with Ryland Homes for the affordable housing units; now, therefore, be it
RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the
occupancy, sale and resale for the affordable housing unit to be developed within PUD 98-05
/ SD 8204 is appropriate; and be it further
RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute
the affordable housing agreement with Ryland Homes in the form as submitted to the City Clerk,
together with such changes as may hereafter become necessary, provided such changes do not
materially increase the obligations of the Town.
