HomeMy WebLinkAbout186-98RESOLUTION NO. 186-98 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE MODERATE INCOME HOUSING UNIT TO BE ESTABLISHED IN PUD 97-09 / SD 8128 (CULET ESTATES - PULTE HOME CORPORATION) WHEREAS, at meetings on July 7, 1998 and July 21, 1998, the Danville Town Council took action on Ordinance No. 98-19 and Resolution No. 106-98, collectively providing approval of Preliminary and Final Development Plan - Rezoning request PUD 97-09 and Final Development - Major Subdivision request SD 8128; and WHEREAS, the approvals provide the property owners (Ben and Marian Culet) and the applicants (Pulte Home Corporation) authorization for a 14-1ot residential development (with one un-subdivided remainder property) on a 15.41 +/- acre site located at 3900 Culet Ranch Road; and WHEREAS, Pulte Home Corporation will be developing this project in conjunction with their Lawrence Estates I and II projects (57 additional lots which are located adjacent and to the east and which are currently under various stages of construction); and WHEREAS, conditions of approval for the project require the development of one unit which shall have a sales price that does not exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Puke Home Corporation is required to execute an Affordable Housing Agreement ("agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing unit; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Pulte Home Corporation for the regulation of occupancy, sale and resale of the affordable housing unit in the subject development on December 15, 1998; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Pulte Home Corporation for the affordable housing unit; now, therefore, be it RE~;OLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the affordable housing unit to be developed within PUD 97-09 / SD 8128 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Pulte Home Corporation in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
