AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE
HOUSING AGREEMENT FOR THE FOR-SALE MODERATE INCOME UNITS
REQUIRED TO BE ESTABLISHED IN PUD 97-05 / SD 8096 AND PUD 98-03 / SD
8179 "OLD BLACKHAWK VILLAGE" - KAUFMAN & BROAD OF NORTHERN
CALIFORNIA, INC. (3637 OLD BLACKHAWK ROAD)
WHEREAS, on January 20, 1998 the Danville Town Council adopted Resolution No. 8-98
approving PUD 97-05 and SD 8096 (a portion of Old Blackhawk Village - Kaufman & Broad
of Northem California, Inc.); and
WHEREAS, on July 21, 1998 the Danville Town Council adopted Resolution No. 116-98
approving PUD 98-03 and SD 8179 (the remaining portion of Old Blackhawk Village - Kaufman
& Broad of Northern California, Inc.); and
WHEREAS, the actions collectively provide for the construction of a 35-unit single family
residential project over 8.4+/- acres located 3637 Old Blackhawk Road (in the vicinity of the
southeast corner of the intersection of Old Blackhawk Road and Lacewood Way and being
further identified as APNs# 203-171-008, -011,013 and -051); and
WHEREAS, conditions of approval for the two projects require that the Kaufman & Broad of
Northern California, Inc. construct a total of three units which shall have a sales price that does
not exceed the maximum price affordable to a four-person household earning 110% of the
median income established for Conira Costa and Alameda Counties; and
WHEREAS, Kaufman & Broad of Northern California, Inc. is required to execute an
Affordable Housing Agreement ("agreement") with the Town of Danville regulating the
occupancy, sale and resale of the affordable housing units; and
WHEREAS, promoting the development of affordable housing within the Town of Danville is
a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and
WHEREAS, the Town Council reviewed the agreement submitted by Kaufman & Broad of
Northern California, Inc. for the regulation of occupancy, sale and resale of the affordable
housing units in the subject development on November 4, 1998; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
agreement with Kaufman & Broad of Northern California, Inc. for the affordable housing units;
now, therefore, be it

RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the
occupancy, sale and resale for the three affordable housing units to be developed within PUD
97-05 / SD 8096 and PUD 98-03 / SD 8179 is appropriate; and be it further
RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute
the Affordable Housing Agreement with Kaufman & Broad of Northem California, Inc. in the
form as submitted to the City Clerk, together with such changes as may hereafter become
necessary, provided such changes do not materially increase the obligations of the Town.
