HomeMy WebLinkAbout130-98 RESOLUTION NO. 130-98 AUTHORIZING PONDEROSA CABLE SYSTEMS, LTD., TO REPLACE THE PERFORMANCE SURETY BOND FOR THE TOWN'S CABLE TELEVISION FRANCHISE WITH A SURETY BOND IN THE AMOUNT OF $15,000 WHEREAS, Section 17-10.1 of the Danville Municipal Code requires the Town' s cable television operator to file a $50,000 performance surety bond with the Town; and WHEREAS, the required surety bond protects the Town in the event the operator fails to comply with any provision of the franchise; and WHEREAS, the Town' s two cable franchise operators, TCI Cablevision and Ponderosa Cable Systems, Ltd., have each filed a $50,000 surety bond since the franchises were granted in 1984 and 1986, respectively; and WHEREAS, Ponderosa Cable Systems, Ltd. has requested that their performance surety bond be reduced to $15,000; and WHEREAS, the Town's Municipal Code allows the Town Council, at its discretion, to authorize an appropriate adjustment to the amount of the surety bond; and now, therefore, be it RESOLVED, by the Danville Town Council that Ponderosa Cable Systems, Ltd., to replace the performance surety bond for the Town' s cable television franchise with a surety bond in the amount of $15,000. APPROVED by the Danville Town Council at a regular meeting on September 1, 1998, by the following vote: AYES: Waldo, NOES: None ABSTAINED: None ABSENT: None Arnerich, Doyle, Greenberg, Shimansky MAYOR APPROVED AS TO FORM: ATTEST: CITY ATTORNEY CITY CLERK
