RESOLUTION NO. 83-98
APPROVING THE VACATION OF LAWRENCE ROAD ABUTTING
SUBDIVISIONS 7876, 8000 AND 8006, FROM CAMINO TASSAJARA TO 435
METERS (1430 FT.) SOUTH
WHEREAS, the Town Council of the Town of Danville approved the Lawrence Road Specific
Plan on September 15, 1992; and
WHEREAS, the Specific Plan requires the realignment of Lawrence Road easterly to create a
four-way intersection with Oakgate Road; and
WHEREAS, the realignment was approved by the Town Council's approval of Subdivision
8000, The Meadows, which offered the Town of Danville the necessary right of way for the
realignment; and
WHEREAS, said realignment is currently under construction and will be physically able to
handle public pedestrian and vehicular traffic upon determination of the Town of Danville City
Engineer; and
WHEREAS, it is in the interests of the public to vacate unused street right-of-way after its
relocation; and
WHEREAS, the realignment leaves land encumbered with unused public street and utility
easements; and
WHEREAS, the Town of Danville may summarily vacate a public street or service easement
which has been superceded by relocation pursuant to the State of California Streets and Highways
Code, Division 9, Part 3, Chapter 4, Section 8330 (a) and
WHEREAS, the realignment of Lawrence Road will leave no person's property access cut off
from a public street (Section 8330 (b) (1)); and
WHEREAS, the vacation of the unused Lawrence Road will not terminate a public service
easement because of reservations in this vacation for existing public service easements (Section
8330 (b) (2)), now, therefore, be it
RESOLVED, by the Danville Town Council that the following portions of Lawrence Road are
hereby vacated as public street and utility easements;
LawTence Road 25 foot widening as shown on Subdivision 2837 recorded in Map
Book 79, pages 34 and 35 and as described in the Resolution by the Board of
Supervisors ofContra Costa County recorded in Book 6055, page 353, on file in the
· Office of the Recorder of said County.
Lawrence Road within lots 15 through 20, 22 through 25, 28 through 31, 33 through
35 and Parcels C through K of Subd,.'vision 8000, The Me~dews, recorded as Serial
No. 98-74775 on file in said Office of the Recorder.
Reserving therefrom, those public utility, storm drain, water line and sanitary sewer
easements lying within the above lots and parcels dedicated for public use by said
Subdivision 8000, The Meadows (see Exhibit 1 for sketch), and be it further
RESOLVED, that upon confirmation from the Town of Danville City Engineer that the relocated
section of Lawrence Road is open to public access, this vacation is appmved and t~e Town staff
is hereby authorized and directed to record this resolution with the Contra Costa County
Recorder.
APPROVED by the Danville Town Council at a regular meeting on June 3, 1998, by the
