RESOLUTION NO. 81-98
APPROVING THE SUMMARY VACATION OF AN EXISTING ACCESS EASEMENT
AND ACCEPTANCE OF A NEW TRAIL EASEMENT WITHIN PARCEL F OF
SUBDIVISION 6699 "ANDERSEN RANCH"
WliF. REAS, the public trail within a portion the "City of Danville Access Easement" within Parcel
"F" of Subdivision 6699 "Andersen Ranch", in the Town of Danville, County of Contra Costa, State
of California, according to the map thereof recorded in map book 299, pages 41 through 46 on file
in the Office of the Recorder of said County, has been physically relocated; and
WHERE?iS, the relocated trail lies within a new public trail easement dedicated to the Town of
Danville by the Anderson Ranch Patio Homes Association; and
WHEREAS, portions 'of the existing access easement are no longer necessary because of the
relocated trail facility; and
WHEREAS, no other public facilities would be affected by the vacation of portions of the existing
access easement no longer necessary; and
WHEREAS, the State of California Streets and Highway Code, Division 9, Part 3, Chapter 4,
Section 8333 (c) authorizes the local agency to vacate a public service easement when the easement
has been superseded by relocation and there are no other public facilities located within the easement;
now, therefore, be it
RESOLVED, that the area described as follows:
BEGINNING AT A POINT ON THE WESTERLY LINE OF SAID PARCEL "F" 49.682

RESOLVED, that from and at~er the date this resolution is recorded, the above-described access
easement no longer constitutes an access easement; and be it further
RESOLVED, that the Town of Danville does hereby accept the newly offered Grant of Trail
Easement from the Anderson Ranch Patio Homes Association as a relocated easement; and be it
further
RESOLVED, that Town staff is hereby authorized and directed to execute and record this resolution
and the newly offered Grant of Scenic Easement on behalf of the Town.
