HomeMy WebLinkAbout075-98RESOLUTION NO. 75-98 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE BELOW MARKET RATE HOUSING UNITS REQUIRED TO BE ESTABLISHED IN PUD 97-04/SD 8078 "VALEROSA" - BRADDOCK & LOGAN GROUP, L.P. (2576 CAMINO TASSAJARA) WHEREAS, on November 5, 1997 the Danville Town Council adopted Resolution No. 164-97 approving PUD 97-04 and SD 8078 ("Valerosa" for Braddock & Logan Group, L.P.); and WHEREAS, the action provides for the construction of a 16-unit single family residential project over 5.7+/- acres located at 2576 Camino Tassajara, being further identified as APN~ 217-010- 006, -007 and -027); and WHEREAS, conditions of approval for the project require the applicant to comply with the Town's Inclusionary Housing Ordinance requirements, providing a minimum of one unit to be made affordable to a "moderate" income household (i.e., a unit whose sales price does not exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties); and WHEREAS, Braddock & Logan Group, L.P. is required to execute an Affordable Housing Agreement with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, conditions of approval for the project provide the applicant with the option to request authorization to comply with the project's Inclusionary Housing Ordinance requirements by establishing for-rent below market rate second units in four of the sixteen residences within the project; and WHEREAS, the applicant, by way of submittal of the draft Affordable Housing Agreement for the project, is requesting authorization to exercise the option to supply for-rent below market rate second units; and WHEREAS, the intent and requirements pertaining to the use of for-rent below market rate second units as a means to satisfy a project' s Inclusionary Housing Ordinance requirement were forrnalized through the May 5, 1998 amendment to the Town' s Inclusionary Housing Ordinance; and WHEREAS, the draft Affordable Housing Agreement for the project has been modified to reflect the recently adopted changes to the Inclusionary Housing Ordinance; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Braddock & Logan Group, L.P. for the regulation of occupancy and use, sale and resale of the affordable housing units in the subject development on May 19, 1998; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Braddock & Logan Group, L.Po for the affordable housing units; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the use and occupancy of the four for-rent below market rate second units to be established in four of the sixteen project residences and the sale and resale for those four housing units to be developed within PUD 97-04/SD 8078 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Braddock & Logan Group, L.P. in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town; and be it further RESOLVED, that the Danville Town Council hereby directs Braddock & Logan Group, L.P. to pay a one-time processing fee $500 to cover staff support costs incurred to date to process this project's Affordable Housing Agreement.
