HomeMy WebLinkAbout072-98RESOLUTION NO. 72-98 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMENT FOR THE MODERATE INCOME HOUSING UNITS REQUIRED TO BE ESTABLISHED IN PUD 97-01 / SD 8047 AND PUD 97-02 / SD 8062 (LAWRENCE ESTATES II - PULTE HOME CORPORATION) WHEREAS, on November 5, 1997 the Danville Town Council adopted Resolution No. 165-97 approving PUD 97-01 and SD 8047 (a portion of Lawrence Estates II - Pulte Home Corporation); and WHEREAS, on November 5, 1997 the Danville Town Council also adopted Resolution No. 166-97 approving PUD 97-02 and SD 8062 (the remaining portion of Lawrence Estates II - Pulte Home Corporation); and WHEREAS, the actions collectively provide for the construction of a 21-unit single family residential project over 11.0+/- acres located at 1160 and 1162 Lawrence Road (fronting 685' +/- along the west side of Lawrence Road at the noahwest corner of the intersection of Culet Ranch Road and Lawrence Road), being further identified as APN/~ 206-020-052 and -053); and WHEREAS, conditions of approval for the two projects require that the applicant construct a total of two units which shall have a sales price that does not exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Pulte Home Corporation is required to execute an Affordable Housing Agreement ("agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Pulte Home Corporation for the regulation of occupancy, sale and resale of the affordable housing units in the subject development on May 5, 1998; and WHEREAS, a staff report was submitted recommending that the Town Council approve the agreement with Puke Home Corporation for the affordable housing units; now, therefore, be it RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the occupancy, sale and resale for the two affordable housing units to be developed within PUD 97- 01 / SD 8047 and PUD 97-02 / SD 8062 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Pulte Home Corporation in the form as submitted to the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town.
