ANNEXING SUBDIVISION 8000 (CALIFORNIA MEADOWS) INTO
DANVILLE STREET LIGHTING AND LANDSCAPE
ASSESSMENT DISTRICT NO. 1983-1
WHEREAS, the Danville Street Lighting and Landscape Assessment District No. 1983-1 (the
"District") was created in 1983 pursuant to the Landscaping and Lighting Act of 1972 (the "1972
Act") and encompasses all of incorporated Danville; and
WHEREAS, on August 5, 1997, the Town Council approved the annexation of Subdivision
8000 ("California Meadows") into the Town of Danville, subject to the terms of an annexation
agreement between the Town and Kaufman & Broad, the subdivider of California Meadows; and
WHEREAS, one of the provisions of the annexation agreement is that Kaufman & Broad agree
to annex the subdivision into the District; and
WHEREAS, Streets and Highways Code Section 22605 provides a procedure for the annexation
of territory into an existing assessment district; and
WHEREAS, on January 20, 1998, the Town Council adopted Resolution No. 6-98, declaring
the intent to annex the subdivision into the District and directing the City Clerk to conduct a
majority protest proceeding for the annexation; and
WHEREAS, a ballot was provided to Kaufman & Broad, the only property owner affected by
the annexation. The ballot has been returned and the City Clerk has verified that no majority
protest exists, as defined in Article XIIID, Section 4(e) of the California Constitution; and
WHEREAS, the Town Council has conducted a public hearing on the annexation; now,
therefore, be it
RESOLVED, by the Danville Town Council that:
The 192 single-family residential parcels in Subdivision 8000 (Califomia Meadows) are
hereby annexed into Danville Street Lighting and Landscape Assessment District No.
1983-1.
The annexed parcels will be included in zones of benefit B, C and D, with annual
assessments of $169.28, $42.68 and $54.00, respectively, which assessments are based
on the existing and previously adopted assessments for the District.
The City Clerk is directed to file this resolution and any other necessary documentation
with the Auditor of the County of Contra Costa so that the assessments may be placed on
the county tax rolls.
