HomeMy WebLinkAbout041-98RESOLUTION NO. 41-98 AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING AGREEMF, NT FOR THE MODERATE INCOME HOUSING UNITS REQUIRED TO BE ESTABLISHED IN PUD 96-02 AND SD 8018 "AUTUMN CREEK" - STANDARD PACIFIC OF NORTHERN CALIFORNIA (CAMINO TASSAJARA AT GLASGOW DRIVE) WI-IEREAS, on November 6, 1996 the Danville Town Council adopted Resolution No. 150-96 approving PUD 96-02 and SD 8018 "Autumn Creek" - Standard Pacific of Northern California; and wmZ. REAS, the approved project will result in the development of a 13-unit single family residential project, which will be associated with a parcel reserved for the future development of a child care facility and an open space parcel; and WHEREAS, the project is located along the south side of Camino Tassajara, near the intersection of Camino Tassajara and Glasgow Drive, being further identified as APN #207-050-019; and WI4E~, conditions of approval for the project require that the applicant construct two units which shall have a sales price not to exceed the maximum price affordable to a four-person household earning 110% of the median income established for Contra Costa and Alameda Counties; and WHEREAS, Standard Pacific of Northern California is required to execute an Affordable Housing Agreement ("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the agreement submitted by Standard Pacific of Northern California for the regulation of occupancy, sale and resale of the affordable housing units in the subject development on March 3, 1998; and WHEREAS, a staff report was submitted recommending that the Town Council approve the Agreement; now, therefore, be it RESOLVED, that the Danville Town Council hereby f'mds the agreement regulating the occupancy, sale and resale of the affordable housing units within PUD 96-02 and SD 8018 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Standard Pacific of Northern California in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
