AUTHORIZING INITIATION OF A GENERAL PLAN AMENDMENT STUDY
FOR SUNCREST HOMES (APPLICANT) AND ELWORTHY (OWNERS)
INVOLVING THE ELWORTHY WESTSIDE PROPERTY
WHEREAS, David Evans and Associates, Inc. representing Suncrest Homes (Applicants) and
Elworthy (Owners) have requested authorization of a General Plan Amendment (GPA) Study
review of the merits of amending the Town's General Plan land use designation for the site from
Public & Open Space - Agriculture to a Residential - Single Family land use designation; and
WHEREAS, the Town of Danville 2005 General Plan includes a land use designation for the
site of Public & Open Space - Agricultural, reflecting the fact that the site was under Agricultural
Preserve Contract at the time the Danville 2005 General Plan was approved; and
WHEREAS, the Town of Danville requires Town Council authorization prior to preparation of
GPA Studies; and
WHEREAS, the Town Council did consider the project proponent's request at a public hearing
on January 20, 1998; and
WHEREAS, the properry's size, location, topographic conditions and relationship to surrounding
properties (both developed and undeveloped) establish it as one of the most developmentally
sensitive properties within the Town; and
WHEREAS, Attachment D of the January 20, 1998 Administrative Staff Report prepared for this
item provides a preliminary list of pertinent General Plan Goals and Policies that will be
considered with the review of any development proposal affecting the property; and
WHEREAS, the project proponents have initiated public outreach efforts with residents of the
most directly affected neighborhoods to secure their input on the project; and
WHEREAS, the public outreach efforts to date have resulted in the development of two lists of
matters of concern and interest (i.e., the October 28, 1997 list from the meeting with the Podva
Neighborhood and the December 10, 1997 list from the meeting with the Danville Ranch
Neighborhood); and
WHEREAS, a staff report was submitted recommending that the Town Council take the
following actions:

Authorize the initiation of a General Plan Amendment Study;
Direct the project proponents to fund an independent "third party" soils and geotechnical
consultant review of the soils and geotechnical information already prepared, or to be
prepared for this property;
Direct the project proponents to fund an independent "third party" consultant review of
an alternate land use plan (or plans), if deemed necessary by staff during the GPA Study
process;
Direct the project proponents to prepare and submit special supplemental graphic and
written background information delineating current site conditions as regards the
following:

Topographic Mapping showing areas of soil creep, landslide deposits (active and
donnan0, groundwater seepage and/or springs, and the Calaveras Seismic Fault
Zone;
Natural Setting Mapping delineating tree cover, riparian corridors, existing ponds,
existing structures and existing areas of paving;
Slope Analysis Mapping (indicating slope categories and corresponding acreage
totals for the following natural slope gradients: less than 10%; 10% - 20%; 20% -
30%, and 33% or greater);
Utility Survey Mapping showing the limits of urban services to the site (i.e.,
EBMUD; CCCSD; PG&E; etc.);
Tree Survey indicating tree type, size and location of trees within, and adjoining,
the proposed development areas;
Storm Drainage Mapping showing existing facilities and drainage and sub-
drainage areas (indicating acreage and 1 O-year and 100-year runoff volumes).
Direct the project proponents to fund the preparation of an utility plan to address the
logical service extensions/improvements to serve the subject property and the surrounding
undeveloped properties; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it

RESOLVED that the Town Council of the Town of Danville authorizes Town staff to conduct
a general plan study of the 458 +/- acre Elworthy westside property in order to consider the merits
of modifying the current general plan land use designation; and, be it further
RESOLVED that the Town Council directs the project proponent's GPA Study application
packet to address the matters of concern and interest raised at the Podva and Danville Ranch
Neighborhood meetings; and be it further
RESOLVED, that in authorizing the above mentioned GPA Study, the Town Council is not
indicating any predisposition to approve the requested General Plan Amendment.
