DECLARING THE INTENT TO ANNEX SUBDIVISION 8000
(CALIFORNIA MEADOWS) INTO DANVILLE STREET LIGHTING AND
LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1
WHEREAS, the Danville Street Lighting and Landscape Assessment District No. 1983-1 (the
"District") was created in 1983 pursuant to the Landscaping and Lighting Act of 1972 (the "1972
Act") and encompasses all of incorporated Danville; and
WHEREAS, on February 4, 1997, the Town Council adopted Resolution No. 17-97, designating
Berryman & Henigar as District Engineer and directing the Engineer to prepare the 1997/98
annual Engineer's Report for the District; and
WHEREAS, on June 3, 1997, the Town Council adopted Resolution No. 71-97, confirming the
diagram and assessment and ordering the levy of the annual assessment for the District after
complying with the majority protest procedures of Article XIIID, Section 4 of the California
Constitution and determining that no majority protest existed; and
WHEREAS, Streets and Highways Code Section 22605 provides a procedure for the annexation
of territory into an existing assessment district; and
WHEREAS, on August 5, 1997, the Town Council approved the annexation of Subdivision
8000 ("California Meadows") into the Town of Danville, subject to the terms of an annexation
agreement between the Town and Kaufman & Broad, the subdivider of California Meadows; and
WHEREAS, one of the provisions of the annexation agreement is that Kaufman & Broad agree
to annex the subdivision into the District; and
WHEREAS, the Contra Costa County Local Agency Formation Commission ("LAFCO")
approved the annexation of the subdivision into Danville subject to the property joining the
District; and
WHEREAS, the 192 homes in the subdivision will be included in zones of benefit B, C and D,
with annual assessments of $169.28, $42.68 and $54.00, respectively; and
WHEREAS, the assessments are based on the Engineer's Report previously prepared and
approved by the Town Council; now, therefore, be it
RESOLVED, by the Danville Town Council that it declares its intent to annex Subdivision 8000
into Danville Street Lighting and Landscape Assessment District No. 1983-1; and, be it further
RESOLVED, that the 192 single-family residences in Subdivision 8000 shall be assessed in
zones of benefit B, C and D; and, be it further
RESOLVED, that the City Clerk is hereby directed to conduct a majority protest proceeding in
accord with state and local laws and procedures; and, be it further
RESOLVED, that on March 17, 1998, at 7:30 p.m., the Town Council will hold a public hearing
on the proposed annexation and assessments; and, be it further
RESOLVED, that the Town Council also continues the public hearing regarding formation of
Danville Community Facilities District No. 97-1 for California Meadows from January 20, 1998,
until February 17, 1998.
