HomeMy WebLinkAbout192-97RESOLUTION NO. 192-97 APPROVING RE-PURCHASE OF FEE CREDITS IN CONJUNCTION WITH THE PURCHASE OF PARCEL B OF MS 856-96 WHEREAS, Doug Oftenhartz is the owner of Parcel B of MS 856-96, immediately adjacent to Green Valley Elementary School in the Town of Danville ("the Town"); and WHEREAS, through Resolution No. 183-97, the Town Council approved the joint purchase of the site with the San Ramon Valley Unified School District ("the District") for the purchase price of $385,000, to be paid through the waiver of $192,500 in development fees by the Town and $192,500 in development fees by the District; and WHEREAS, through Resolution No. 176-97, the Town Council transferred funds from the General Fund into the Building Special Revenue Fund in order to fund the cost of building permit fee waivers to be granted by the Town to Mr. Oftenhartz; and WHEREAS, the Town now desires to re-purchase the fee waivers granted to Mr. Oftenhartz by the Town, for a purchase price of $177,100; and WHEREAS, said re-purchase results in a substantial financial savings to the Town and constitutes prudent and appropriate financial stewardship; and WHEREAS, Mr. Oftenhartz assumes all responsibility for shared improvements and costs associated with Parcel A of MS 856-96 (Oakmont of Danville); now therefore be it RESOLVED, by the Danville Town Council that it approves the re-purchase of fee waivers granted to Doug Offenhartz in conjunction with the joint Town of Danville/San Ramon Valley Unified School District purchase of Parcel B of MS 856-96; and be it further RESOLVED, that the Town Council hereby appropriates $177,100 from the Building Special Revenue Fund for the re-purchase of the subject fee waivers and authorizes the Town Manager to take all steps necessary to complete the purchase, including the execution of a purchase agreement and any other necessary documents.
