HomeMy WebLinkAbout190-97RESOLUTION NO. 190-97 AUTHORIZING THE MAYOR TO EXECUTE A JOINT EXERCISE OF POWERS AGREEMENT BETWEEN CONTRA COSTA COUNTY AND THE TOWN OF DANVILLE RELATING TO THE PROVISION OF SERVICES TO THE ALAMO SPRINGS PROJECT WHEREAS, the Town of Danville and Contra Costa County have approved a 53-1ot residential subdivision commonly known as Alamo Springs; and WHEREAS, once constructed, the Alamo Springs project will remain located partially within the corporate limits of the Town of Danville and partially within the unincorporated community of Alamo; and WHEREAS, the approvals granted by the County and Town require that the Town of Danville will provide police and maintenance services to the entire Alamo Springs project, including those parcels remaining in the County and that a funding mechanism will be created to reimburse the Town for the cost of providing these services; and WHEREAS, the Contra Costa County Local Agency Formation Commission ("LAFCO") has approved the creation of County Service Area M-30 for the purpose of funding the Town's provision of these services; and WHEREAS, in order to implement the project conditions of approval and County Service Area M-30, the Town and County must enter into a joint exercise of powers agreement, authorizing the Town to provide specified services within the unincorporated portion of the Alamo Springs project and authorizing the County to collect assessments and reimburse the Town for the cost of the services provided; now, therefore, be it RESOLVED, by the Danville Town Council that the Mayor is hereby authorized to execute a Joint Exercise of Powers Agreement between Contra Costa County and the Town of Danville relating to the provision of services to the Alamo Springs project.
