APPROVING A SUBLEASE AT 1025 LA GONDA WAY,
HOUSE #1 AT HAP MAGEE RANCH PARK
WHEREAS, the Town of Danville possesses, as tenant in common with Contra Costa County,
certain real property and improvements located at 1025 La Gonda Way, Danville, California; and
WHEREAS, the real property was acquired for the purpose of creating a public park; and
WHEREAS, the Master Plan for the park calls for the structure at 1025 La Gonda Way to be
rehabilitated for recreation uses and cultural art activities; and
WHEREAS, David DeHerrera, Maintenance Services Manager for the Town of Danville, has
submitted a proposal to the Town whereby he will reside in and rehabilitate the structure over
a three-year period, in exchange for below-market-rate rent and other financial considerations;
and
WHEREAS, a sublease has been prepared setting forth the terms and conditions under which
the Town will rent such real property and the Town and Mr. DeHerrera desire to enter into such
sublease; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a sublease with David DeHerrera of the property
located at 1025 La Gonda Way, in the form as lodged with the City Clerk, together with such
changes as may hereafter become necessary, provided such changes do not materially increase
the obligations of the Town thereunder.
APPROVED by the Danville Town Council at a regular meeting on November 5, 1997, by the
following vote:
