AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE
HOUSING AGREEMENT FOR THE MODERATE INCOME HOUSING UNIT
REQUIRED TO BE ESTABLISHED PUD 9%03 AND SD 8043
(CREEKSIDE COMMONS - DANVILLE LAND AND DEVELOPMENT COMPANY)
WHEREAS, on May 20, 1997 the Danville Town Council adopted Resolution No. 67-97
approving PUD 93-07 and SD 8043 (Creekside Commons - Danville Land and Development
Company); and
WHEREAS, the action provides for construction of a 14-unit single family residential project on
a 5.9 +/- acre parcel located at the southwest comer of Camino Ramon and Greenbrook Drive
(APN # 218-783-001 and #218-430-025); and
WHEREAS, conditions of approval for the project require that the applicant construct one unit
which shall have a sales price that does not exceed the maximum price affordable to a four-person
household earning 110% of the median income established for Contra Costa and Alameda
Counties; and
WHEREAS, Danville Land and Development Company is required to execute an Affordable
Housing Agreement ("agreement") with the Town of Danville regulating the occupancy, sale and
resale of the affordable housing unit; and
WHEREAS, promoting the development of affordable housing within the Town of Danville is
a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and
WHEREAS, the Town Council reviewed the agreement submitted by Danville Land and
Development Company for the regulation of occupancy, sale and resale of the affordable housing
unit in the subject development on September 3, 1997; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
agreement with Danville Land and Development Company for the affordable housing unit; now,
therefore, be it
RESOLVED, that the Danville Town Council hereby finds that the agreement regulating the
occupancy, sale and resale for the affordable housing unit within PUD 97-03 and SD 8043 is
appropriate; and be it further
RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute
the Affordable Housing Agreement with Danville Land and Development Company in the form
as lodged with the City Clerk, together with such changes as may hereafter become necessary,
provided such changes do not materially increase the obligations of the Town thereunder.
