TRANSMITTING THE TOWN OF DANVILLE'S COMMENTS ON THE DRAFT
ENVIRONMENTAL IMPACT REPORT FOR THE TASSAJARA PROJECT
WHEREAS, Contra Costa County has requested that affected agencies review and comment on the
Draft Environmental Impact Report (DEIR) for the Tassajara project; and
WHEREAS, the proposed Tassajara project would have widespread, significant impacts on the
Town of Danville; and
WHEREAS, the Town's 2005 General Plan directs that the Town take necessary steps to assure
the Town's residents that future land use decisions in the Tassajara area will not adversely affect their
quality of life; and
WHEREAS, the DEIR violates even the most minimal standards of adequacy under the California
Environmental Quality Act (CEQA) and the CEQA Guidelines;
WHEREAS, it is critical that the Town convey DEIR comments in writing to Contra Costa County
and demand that they be adequately addressed in the context of CEQA; now, therefore, be it
RESOLVED, that the Danville Town Council has determined and orders as follows:
1. A revised draft EIR is required because the DEIR is so fundamentally and basically inadequate
and conclusory in nature that meaningful public review and comment are precluded.
2. Town residents and other governmental agencies and non-governmental entities are requested
to comment on the DEIR, and are encouraged to utilize the Town's comment letter as a basis
for additional comments.
3. The DEIR should recognize that numerous mitigation measures described in the DEIR and
presumed to be constructed to mitigate project impacts are unacceptable to the Town. These
include the following:
(A) Construction of a free right-turn lane on eastbound Camino Tassajara at Crow
Canyon Road is unacceptable to the Town of Danville.
(B) Construction of a free right-turn lane on northbound Crow Canyon Road at
Camino Tassajara is unacceptable to the Town of Danville.
(C) Removal of the median island on westbound Camino Tassajara at Crow Canyon
Road is unacceptable to the Town of Danville.
(D) Closure of existing commercial driveways on Camino Tassajara or Crow
Canyon Road is unacceptable to the Town of Danville.
(E) Construction of any capital project necessitating the taking of private property
to accommodate Tassajara project traffic is unacceptable to the Town of
Danville.
(F) Construction of a limited access arterial, parkway, or other roadway through the
southern portion of the Lawrence Road area, linking Tassajara Valley with
Dougherty Valley via Lawrence Road, is fundamentally inconsistent with the
Lawrence/Leema Road Specific Plan and the Danville General Plan, and is
unacceptable under any circumstances to the Town of Danville.
APPROVED by the Danville Town Council at a Regular Meeting on May 20, 1997, by the following
vote:
