APPROVING MODIFICATION OF AN INCENTIVE PACKAGE FOR A
PREVIOUSLY APPROVED HERITAGE RESOURCE DESIGNATION TO ALLOW
BUSINESS AND PROFESSIONAL OFFICE USES WITHIN AN EXISTING
STRUCTURE LOCATED AT 402 HARTZ AVENUE (APN: 208-022-015).
WHEREAS, on February 15, 1994 the Town Council granted approval of a Heritage Resource
designation and incentive package for the existing structure located at 402 Hartz Avenue; and
WHEREAS, Blair Barry (Applicant) and Joseph and Rosalind Hirsch (Owners) are proposing
to amend the Heritage Resource incentive package to allow Business and ProfessJional Office
uses (as defined by the Downtown Business District Ordinance) to locate an architectural firm
and contractor's office at the subject site; and
WHEREAS, Ordinance No. 89-8 (Historic Preservation) of the Town of Danville., establishes
criteria for Heritage Resources and incentives that the Town can offer for designation; and
WHEREAS, the Heritage Resource Commission did review the proposal at a noticed hearing
on April 4, 1997; and
WHEREAS, the Heritage Resource Commission did hear and consider all reports,
recommendations and testimony submitted in writing and presented at the hearing; and the
Heritage Resource Commission voted to approve a recommendation that the Town Council
approve the proposed modification to the incentive package; and
WHEREAS, the Town Council did review the project at a noticed public hearing on April 15,
1997; and
WHEREAS, the public notice of this action was given in all respects as required by law; and
WHEREAS, a staff report was submitted recommending that the Town Council approve the
request; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore be it
RESOLVED, that the Danville Town Council approves the modification to the: previously
approved incentive package and makes the following findings in support of this action:
1. As an incentive to encourage owners of historic properties to participate in the Heritage
Resource program, the Historic Preservation Ordinance (Ordinance No. 89-8) grants the

Town authority to waive restrictions on the location of office uses in Area 1 of the
Downtown Business District.

There is no evidence before the Town that business and professional office uses at the
subject site will result in a negative impact to the retail atmosphere of Area 1 of the
Downtown Business District; and be it
FURTHER RESOLVED, that the Danville Town Council approves the following additional
incentive as part of the Heritage Resource incentive package for the property:

Business and Professional office uses, as defined by Section 32-15.16 b.2 and b.3 (Area
6; Business and Professional Offices) of the Downtown Business District Ordinance
(Ordinance No. 94-08) are permitted uses at the subject site; and be it
FURTHER RESOLVED, that the Town Council approves the modified incentiive package
based on the following conditions:

No heavy equipment, materials or supplies associated with the construction business shall
be stored on-site.
2. Any new signage for the site shall require a separate sign permit application.

The window frames and building fascia of the former residence shall be repainted with
the proposed grey-green paint color.

Parking shall be permitted at the rear of the site with no restrictions on the number of
parking spaces. There shall be no parking permitted in the driveway.
.
Parking associated with the subject business shall not be permitted in the adjacent
Veterans' Memorial Hall parking lot located immediately north of the subject site.

Substantial interior modifications to the former residence shall require prior review and
approval by the Heritage Resource Commission.
APPROVED by the Danville Town Council at a Regular Meeting on April 15, 1997, by the
following vote:
