HomeMy WebLinkAbout050-97 RESOLUTION NO. 50-97 APPROVING POLICIES FOR THE TRI-VALLEY TRANSPORTATION DEVELOPMENT FEE WHEREAS, the Town of Danville is a participating member of the Tri-Valley Transportation Council (TVTC); and WHEREAS, each TVTC member has adopted the Tri-Valley Transportation Plan/Action Plan for Routes of Regional Significance and agreed to pursue the joint adoption of transportation development fees; and WHEREAS, certain mutually agreed policies must be adhered to by each of the Tri-Valley jurisdictions if an equitable tee program to implement the plan is to be enacted by each jurisdiction; now, therefore, be it RESOLVED, by the Danville Town Council that the following policies are approved for inclusion in the Tri-Valley Transportation Development Fee: 1. Each jurisdiction shall adopt their own version of the Tri-Valley Transportation Development Fee (TVTDF), in substantially the same language as each of the other jurisdictions, including the high priority projects listed on Exhibit 1. 2. The proposed fee rates shall be those shown on Exhibit 2. Additional consideration must be given to existing local traffic fee schedules in Tri-Valley ju~sdictior~. Current Town of Danville Assessment District, Benefit District, TIP, and SCC Sub-Regional fees should be compared to other Tri-Valley jurisdictions current fees to estimate the total burden of all fees -- including the proposed TVTDF. 3. That changes in any jurisdiction's TVTDF will not be unilateral, and will require comprehensive review by each of the Tri-Valley jurisdictions in terms of equity and impact of the changes on the completion of those stated projects contemplated to be funded by the ~IYTDF. 4. That a Joint Exercise of Powers Agreement (JEPA) will be formed to set the fees to be administered by each jurisdiction in accordance with TVTC administrative guidelines. 5. The first use of the fees shall be for the 1-580/I-680 interchange project, including reimbursement of funds advanced by member jurisdictions for that project, for preparation of the "Combined Study" ($15,000 per jurisdiction), and costs associated with implementation of the TVTDF ($3,000 per jurisdiction). 6. Prioritization of TVTDF improvement projects and the programming of funding for these projects shall consider the following criteria: a. Project readiness and status of environmental reviews and necessary approvals. b. Ability to use 7VTDF funds to 'leverage "other external funding sources. c. Commitment of funding from other external sources. 7. Reimbursement of fccs advanced by member jurisdictions shall include interest fixed at 5 percent. 8. ~lhe rate schedule shall be based on the average of the a.m. and p.m. peak hour trip rates and uniform land use categories. 9. The Southern Contra Costa (SCC) Regional Fee shall remain intact, and the TVTDF collected in the SCC area shall be adjusted to prevent double-charging for projects that are included on both the Southern Contra Costa Regional Fee list and the TVTDF list. 10. The fees will be adjusted every five years, or as needed, to incorporate updated project cost estimates, rates of development, project priorities, and external funding commitments. Each update shall also include a financial plan, specifying cash flow and project estimates. 11. The fee rates will be automatically adjusted on a annual basis to reflect changes in the construction cost index published in the Engineering News Record. 12. Additional projects may be added to the project list by unanimous vote of all TVTC jurisdictions, provided that the fee rate and cash flow can accommodate the added projects as well as the currently funded projects. 13. Tri-Valley jurisdictions agree to seek external funding for the highest priority PAGE 2 OF RESOLUTION NO. 50-97 projects, and if successful, support the carryover of any excess funds for implementation of the next highest priority project. 14. Each jurisdiction shall levy the TVTDF on all Tri-Valley development not legally precluded from the fee. Development agreements which replace or supersede agreements will impose the TVTDF requirement on the basis of net incremental increases in peak period trc~c generation. 15. TVTC may adopt exemption rules by unanimous agreement (e.g. affordable housing). 16. $3,000 is appropriated from the Local Street Maintenance and Improvement Fund sub-account of the Capital Improvement Fund to cover costs associated with implementation of the 'IYTDF, to be reimbursed by future 'IYTDF funds. 17. After funding has been completed for the 1-580//1-680 Interchange Project, future funds from the TVTDF shall be allocated annually on a proportional basis to the 1-680 Auxiliary Lane Project. This project shall have the same priority for a proportion of annually available TVTDF funds as other high priority projects.
