DECLARING INTENT TO LEVY AND COLLECT ASSESSMENTS
FOR DANVILLE STREET LIGHTING AND LANDSCAPE
ASSESSMENT DISTRICT NO. 1983-1 FOR FISCAL YEAR 1997-98
AND SETTING JUNE 3, 1997 AS THE DATE FOR PUBLIC HEARING
WHEREAS, on February 4, 1997, the Town Council adopted Resolution No. 17-97, directing
the preparation of the annual report for Danville Street Lighting and Landscape Assessment
DJ[strict No. 1983-1 (the "District"); and
WHEREAS, pursuant to that resolution, a preliminary engineer's report has been prepared in
accordance with Article 4 (beginning with Section 22565 of the California Streets and Highways
Code) of Chapter 1 of the Landscaping and Lighting Act of 1972, filed with the City Clerk, and
duly considered by this Council; and
WHEREAS, it is the intention of this Town Council to levy and collect assessments within the
District for the fiscal year 1997-98. Within the District, the existing and proposed improvements
are generally as described on Exhibit 1 attached hereto and hereby made a part thereof; and
WHEREAS, the District includes all parcels of land within the incorporated limits of the Town
of Danville; and
WHEREAS, reference is hereby made to the aforementioned Engineer's Report, on file with the
City Clerk, for a full and detailed description of the improvements, the boundaries of the
proposed maintenance assessment district and the proposed assessments upon assessable lots and
parcels of land within said district; and
WHEREAS, the current levies for equivalent dwelling units for Benefit Zones A, B, C and D
are $34.53, $169.28, $42.68 and $54.00 respectively; and
WHEREAS, the proposed fiscal year 1997-98 levies for equivalent dwelling units for all benefit
zones will remain unchanged; and
WHEREAS, there are no proposed new improvements, or any substantial changes in existing
improvements; and
WHEREAS, on February 18, 1997, the Town Council adopted Resolution No. 25-97,
establishing majority protest procedures for the District in order to comply with the provisions
of Article XIIID, Section 4 of the California Constitution; now, therefore be it
RESOLVED, by the Danville Town Council that it declares its intent to levy and collect
a~se~ment~ for Danville Street Lighting and Landscape A~e~ment District No. 1983-1 for fiscal
year 1997-98; and, be it
FURTHER RESOLVED, that on Tuesday, June 3, 1997, at 7:30 p.m., in the regular meeting
place of the Town Council, 201 Front Street, Danville, California, a public hearing by the Town
Council will be held on the question of the levy of the proposed assessments; and, be it
FURTHER RESOLVED, that the City Clerk is hereby directed to conduct the majority protest
proceedings required by Article XIIID, Section 4 of the California Constitution in accord with
the procedures set forth in Resolution No. 25-97; and, be it
FURTHER RESOLVED, that the report prepared and filed by the Engineer on March 13, 1997
contains all of the elements required for such reports by the Landscaping and Lighting Act of
1972 and Article XIIID, Section 4 of the California Constitution, including: 1) an estimate of the
annual cost of the improvements; 2) a diagram for the Assessment District; and 3) an assessment
of the estimated annual costs of improvements, and is hereby deemed sufficient and preliminarily
approved. The report shall stand as the Engineer's Report for all subsequent proceedings under
and pursuant to the foregoing resolution.
