HomeMy WebLinkAbout025-97RESOLUTION NO. 25-97 ESTABLISHING MAJORITY PROTEST PROCEDURES FOR DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1 WHEREAS, the Danville Street Lighting and Landscape Assessment District No. 1983-1 (the "District") was created in 1983 pursuant to the Landscaping and Lighting Act of 1972 (the "1972 Act"); and WHEREAS, Proposition 218, enacted by the voters on November 5, 1996, requires the Town to conduct a mail out ballot protest procedure in order to ratify continuance of the District; and WHEREAS, neither Article XIIID, Section 4 of the California Constitution nor the 1972 Act sets forth all of the procedures necessary to conduct this protest procedure and there are currently no pending legislative proposals to create these procedures; and WHERF~S, in order to conduct a fair and accurate protest procedure regarding the continuance of the District, the Danville Town Council finds it necessary to adopt local procedures; now, therefore, be it RESOLVED, by the Danville Town Council that the majority protest procedures for Danville Street Lighting and Landscape Assessment District No. 1983-1 are hereby approved as set forth in Exhibit 1, a copy of which is attached hereto and incorporated herein.
